民生的權(quán)利化：以生存權(quán)為例

【摘要】：社會的飛速發(fā)展帶來經(jīng)濟進步的同時，，也誘發(fā)某些社會問題�？鬃铀缘摹安换脊讯疾痪�，其實很好地揭露了當下中國某些社會問題的產(chǎn)生原因。涉及民眾基本尊嚴的生存權(quán)利，如果得不到保障，就很可能觸發(fā)社會不和諧、不穩(wěn)定的底線。本文試圖將民生保障落實到生存權(quán)的這一層面，通過梳理生存權(quán)的發(fā)展脈絡(luò)，論述其從綱領(lǐng)性、抽象的概念發(fā)展到基于人性尊嚴的具體的生存權(quán)的內(nèi)涵，揭示我國生存權(quán)保障的現(xiàn)狀，以一種綜合定義的方式，探討我國生存權(quán)的社會保障問題的完善與發(fā)展。在生存權(quán)保障的實現(xiàn)方面，除了提倡生存權(quán)作為防御權(quán)的一面以外，還在國家義務(wù)的層面上闡述了公民生存權(quán)作為社會權(quán)利的一面。
[Abstract]:The rapid development of society brings economic progress, but also induces some social problems. Confucius's words, "do not suffer from lack of balance", in fact, a good exposure to the causes of some social problems in China. The right to live with the basic dignity of the people, if not guaranteed, is likely to trigger social disharmony and instability of the bottom line. This paper attempts to implement the livelihood guarantee to this level of the right to life, through combing the development context of the right to existence, discusses its development from programmatic, abstract concept to the connotation of the specific right of existence based on human dignity. This paper reveals the present situation of the guarantee of the right of existence in our country, and probes into the perfection and development of the social security of the right of existence in our country in a way of comprehensive definition. In the aspect of the realization of the right of existence, besides advocating the right of existence as the right of defense, it also expounds the aspect of citizen's right of existence as a social right at the level of national obligation.
