【摘要】：憲法作為國家的根本大法,不僅應(yīng)當(dāng)是審慎制定的良善之法,更不可朝令夕改。1913年,梁啟超以《進(jìn)步黨擬中華民國憲法草案》作為進(jìn)步黨參與立憲的政治主張。緣何梁氏在憲法草案中放棄君主立憲制而采納民主共和制,由對美國聯(lián)邦制之偏好轉(zhuǎn)向了單一制國家結(jié)構(gòu),不采用責(zé)任內(nèi)閣制而提倡總統(tǒng)制?這當(dāng)中體現(xiàn)了立憲中各派政治角力相互妥協(xié)、國家權(quán)力相互制衡的過程。也啟發(fā)了當(dāng)今開展法治建設(shè)不可僅移植國外法律,吸收國外法治思想,更為必要的是須建立起超越政治與黨派權(quán)力的憲法權(quán)威,實現(xiàn)對憲法理念的本土化改造。
[Abstract]:As the fundamental law of the country, the constitution should not only be a prudent law of good and good, but also cannot be changed day by day. In 1913, Liang Qichao took the "draft Constitution of the Republic of China" as the political proposition of the Progressive Party to participate in the constitution. Why did Liang give up the constitutional monarchy and adopt the democratic republic in the draft constitution?. Instead of adopting the responsible cabinet system, he advocated the presidential system instead of the unitary state structure. This reflects the constitutionalism of political struggle to compromise, state power checks and balances process. It also inspires us to carry out the construction of rule of law not only to transplant foreign laws, but also to absorb the thought of rule of law in foreign countries. What is more necessary is to establish the constitutional authority beyond the power of politics and party, and to realize the localization transformation of the concept of constitution.
