【摘要】：網(wǎng)絡(luò)因其開放性、廣泛性、數(shù)字化、即時(shí)互動(dòng)性等特點(diǎn),已成為我國(guó)公民實(shí)現(xiàn)言論表達(dá)自由的重要途徑。同時(shí),網(wǎng)絡(luò)作為一把“雙刃劍”,也為危害言論打開了的方便之門。網(wǎng)絡(luò)環(huán)境下表達(dá)自由與他人權(quán)利、社會(huì)利益等孰輕孰重,并不是一個(gè)非此即彼的問題。在網(wǎng)絡(luò)環(huán)境中的言論表達(dá)自由具有什么性質(zhì)、國(guó)家政府能否在網(wǎng)絡(luò)信息治理中對(duì)其進(jìn)行干預(yù)、表達(dá)自由與政府信息治理的平衡點(diǎn)在哪兒已成為亟需解決的問題。本文試從分析網(wǎng)絡(luò)環(huán)境中言論表達(dá)自由的價(jià)值和保護(hù)入手,探討政府網(wǎng)絡(luò)信息治理中對(duì)表達(dá)自由進(jìn)行規(guī)制的正當(dāng)性,分析我國(guó)現(xiàn)行法律制度的保護(hù)措施及存在問題,力求尋找一個(gè)最佳結(jié)合點(diǎn),在保護(hù)公民自由行使言論表達(dá)自由權(quán)利的同時(shí),切實(shí)維護(hù)社會(huì)秩序穩(wěn)定和國(guó)家安全。本文主要分為以下幾部分：首先,在引言部分,介紹互聯(lián)網(wǎng)發(fā)展對(duì)公民行使表達(dá)自由的積極意義及存在隱患,引出本文探討政府網(wǎng)絡(luò)信息治理對(duì)網(wǎng)絡(luò)表達(dá)自由的保護(hù)及規(guī)制的必要性。第一部分,介紹表達(dá)自由、網(wǎng)絡(luò)表達(dá)等相關(guān)概念,以及保護(hù)網(wǎng)絡(luò)表達(dá)自由的價(jià)值。第二部分,介紹網(wǎng)絡(luò)表達(dá)可能造成的負(fù)面影響,分析網(wǎng)絡(luò)表達(dá)自由是有限度的,引出對(duì)網(wǎng)絡(luò)表達(dá)自由進(jìn)行適當(dāng)規(guī)制的必要性。第三部分,介紹美國(guó)、德國(guó)對(duì)政府網(wǎng)絡(luò)信息治理的規(guī)定,比較兩國(guó)不同的適用原則及特點(diǎn)。第四部分,介紹我國(guó)相關(guān)法律制度,分析立法現(xiàn)狀及所面臨的問題。第五部分,從政府審慎定位、法律適用原則、加強(qiáng)專門性立法等方面,探討如何健全和完善我國(guó)政府網(wǎng)絡(luò)信息治理的法律制度。
[Abstract]:Because of its characteristics of openness, extensiveness, digitalization and instant interaction, Internet has become an important way for Chinese citizens to realize freedom of speech and expression. At the same time, the network as a "double-edged sword", but also open the door to harm speech. Freedom of expression and other rights, social interests and so on in the network environment is not a question of one or the other. What is the nature of the freedom of speech and expression in the network environment, whether the national government can intervene in the network information governance, where the balance point between the freedom of expression and the government information governance has become a problem that needs to be solved. This article tries to analyze the value and protection of freedom of expression in the network environment, discusses the legitimacy of the regulation of freedom of expression in the government network information governance, and analyzes the protection measures and existing problems of our country's current legal system. We should strive to find the best combination point to protect citizens' free exercise of the right to freedom of expression and expression, and at the same time, to effectively maintain social order, stability and national security. This paper is mainly divided into the following parts: first, in the introduction part, it introduces the positive significance and hidden danger of Internet development to citizens' exercise of freedom of expression. This paper discusses the necessity of government network information governance to protect and regulate the freedom of network expression. The first part introduces the concepts of freedom of expression, network expression and the value of protecting freedom of expression. The second part introduces the possible negative effects of network expression, analyzes the limitations of network freedom of expression, and leads to the necessity of appropriate regulation of network freedom of expression. The third part introduces the regulations of government network information governance in the United States and Germany, and compares the different applicable principles and characteristics between the two countries. The fourth part, introduces the related legal system of our country, analyzes the legislation present situation and the question which faces. The fifth part discusses how to perfect and perfect the legal system of the government network information governance from the following aspects: the government's prudent orientation, the principle of the application of the law, and the strengthening of the specialized legislation.
