【摘要】：財產(chǎn)申報制度被譽(yù)為"陽光法案"、"終端反腐"、"反腐利器",國外早已將其作為不可或缺的反腐舉措。國外財產(chǎn)申報制度的形式主要有憲法規(guī)定、反腐敗法規(guī)定、反腐敗相關(guān)法律規(guī)定、專門立法,其內(nèi)容包括申報的主體、內(nèi)容、時間、受理、提交、審核、公開、問責(zé)、保存等,其原則為法制化、有限申報、獨(dú)立審核、相對公開、絕對問責(zé)、自上而下。中國應(yīng)借鑒國外經(jīng)驗,懸起財產(chǎn)申報的達(dá)摩克利斯之劍,才能有望打破當(dāng)前的反腐膠著狀態(tài)。
[Abstract]:Property declaration system is regarded as "sunshine act", "terminal anti-corruption" and "anti-corruption sharp weapon", which has long been regarded as an indispensable anti-corruption measure abroad. The forms of the property declaration system abroad are mainly constitutional provisions, anti-corruption related laws, and special legislation. Their contents include the main body of the declaration, the content, the time, the acceptance, the submission, the examination, the publicity, the accountability, the preservation, and so on. Its principles are legalization, limited declaration, independent audit, relative openness, absolute accountability, top-down. China should learn from foreign experience and hang up the sword of Damocles in order to break the current state of anti-corruption.
