【摘要】：證人證言對于發(fā)現(xiàn)案件的事實真相有重要的作用，因而法律規(guī)定每個公民都有作證的義務(wù)。而在實際生活中很多證人出于情感和道德的原因不愿意作證，證人基于自身職業(yè)道德的保密義務(wù)而拒絕作證，是其中的一個重要部分，國家公權(quán)力是否能夠強制要求這些證人作證？刑事證人職業(yè)拒證權(quán)能夠更好的維護執(zhí)業(yè)者與委托人之間的信賴關(guān)系，促進(jìn)該職業(yè)的發(fā)展與繁榮，然而這也有可能使得一些犯罪人逃脫法律的制裁，法律的正義得不到伸張。在我國2013年正式實施的新刑訴法中明確規(guī)定了辯護律師—委托人拒證權(quán)，這是我國職業(yè)拒證權(quán)制度的一個突破，而其他職業(yè)主體能否享有呢？這需要我們的立法者權(quán)衡各方面的利益，對其進(jìn)行深層次的分析和探討。 本文分為四個章節(jié)，首先對刑事證人的職業(yè)拒證權(quán)基本概念及我國職業(yè)拒證權(quán)的歷史與現(xiàn)狀進(jìn)行了介紹；接著主要介紹了刑事證人職業(yè)拒證權(quán)的一般規(guī)則，里面詳細(xì)論述了作為刑事證人職業(yè)拒證權(quán)基礎(chǔ)的職業(yè)交流概念和特征，及職業(yè)信任的重要性；職業(yè)拒證權(quán)本身起源于西方，因而在第三部分，對西方國家的刑事證人職業(yè)拒證權(quán)進(jìn)行了考察，，對其發(fā)展的過程、存在的正當(dāng)性進(jìn)行了分析，介紹了不同學(xué)說關(guān)于刑事證人職業(yè)拒證權(quán)制度的爭論；最后根據(jù)我國的實際情況，提出了完善該制度的原則，建議對我國的刑事證人職業(yè)拒證權(quán)中的律師主體范圍要更明確，同時可以考慮將心理醫(yī)生這一職業(yè)納入刑事證人職業(yè)拒證權(quán)中來。
[Abstract]:Witness testimony plays an important role in discovering the truth of the case, so the law imposes an obligation on every citizen to testify. In real life, many witnesses are unwilling to testify for emotional and moral reasons. Witnesses refuse to testify on the basis of their professional ethics' duty of confidentiality, which is an important part of it. Can the public power of the State compel these witnesses to testify? The criminal witness's right of professional refusal can better maintain the trust relationship between the practitioner and the client, and promote the development and prosperity of the profession. However, it may also make some criminals escape the sanction of the law, and the justice of the law can not be done. In 2013, the new criminal procedure law of our country has clearly stipulated the right of defense counsel-client to refuse to testify, which is a breakthrough of the system of professional refusal of evidence in our country, but can other professional subjects enjoy it? This requires our legislators to weigh the interests of all aspects of the in-depth analysis and discussion. This paper is divided into four chapters. Firstly, it introduces the basic concept of the criminal witness's right of professional refusal and the history and present situation of the right of professional refusal of proof in our country. Then it mainly introduces the general rules of the criminal witness's right of professional refusal, and discusses in detail the concept and characteristics of professional exchange as the basis of the right of criminal witness's professional refusal, and the importance of professional trust. In the third part, the author makes an investigation on the right of professional denial of evidence of criminal witnesses in western countries, and analyzes the process of its development and the legitimacy of its existence. This paper introduces the arguments of different theories about the system of criminal witness's right of professional refusal to testify; Finally, according to the actual situation of our country, the paper puts forward the principles of perfecting the system, and suggests that the scope of the lawyer's subject in the criminal witness's right of professional refusal to testify should be more clearly defined. At the same time, we can consider that the profession of psychiatrist should be included in the right of criminal witness's professional refusal.
