論消費(fèi)爭議仲裁解決機(jī)制

【摘要】:我國消費(fèi)糾紛每天都在上演,每年中央電視臺(tái)3.15晚會(huì)都會(huì)爆出關(guān)乎百姓衣食住行各個(gè)方面的侵權(quán)事件和假冒產(chǎn)品,人們對(duì)不法商家深惡痛絕的同時(shí),也表現(xiàn)出對(duì)政府監(jiān)管能力的失望。我國消費(fèi)爭議頻發(fā)的背后,反映出現(xiàn)有消費(fèi)者權(quán)利救濟(jì)手段還存在很多不足。我國消費(fèi)者權(quán)益救濟(jì)措施包括:和解、調(diào)解、申訴、仲裁和訴訟,這五種救濟(jì)措施各有優(yōu)缺點(diǎn),都沒能很好地發(fā)揮老百姓對(duì)市場的監(jiān)管作用。正因如此,大量商家愿意選擇冒險(xiǎn),通過違法假冒行為獲得不正當(dāng)?shù)氖找?擾亂了正常市場經(jīng)濟(jì)秩序。為維護(hù)消費(fèi)者的合法權(quán)益,維持穩(wěn)定的市場秩序,尋找更具有實(shí)效性的消費(fèi)爭議救濟(jì)措施成為當(dāng)務(wù)之急。從20世紀(jì)初開始,我國很多省市如山東、河南、青島等等開始探索采用仲裁方式解決消費(fèi)爭議,這為我國構(gòu)建消費(fèi)爭議仲裁機(jī)制提供參考系。同時(shí),世界其他國家如美國、西班牙、葡萄牙等等較早地采用仲裁方式解決消費(fèi)爭議,消費(fèi)爭議仲裁制度更加完善,我國可以吸取國外先進(jìn)理念和措施。從我國目前消費(fèi)爭議仲裁的現(xiàn)狀來看,存在主要的問題是對(duì)消費(fèi)爭議仲裁沒有統(tǒng)一的立法,模式各不相同,各自為政,未能發(fā)揮消費(fèi)爭議仲裁方式的優(yōu)勢。因此,建立專門的消費(fèi)爭議仲裁機(jī)制勢在必行,應(yīng)從立法、基本原則、組織機(jī)構(gòu)建設(shè)、啟動(dòng)方式、仲裁程序及裁決效力等方面對(duì)消費(fèi)爭議仲裁機(jī)制進(jìn)行整體的設(shè)想。同時(shí),針對(duì)目前網(wǎng)絡(luò)消費(fèi)的日益激增,爭議也越來越多,建立網(wǎng)上消費(fèi)爭議仲裁系統(tǒng),通過網(wǎng)絡(luò)快速解決網(wǎng)上消費(fèi)爭議,定能規(guī)范網(wǎng)上交易市場,促進(jìn)網(wǎng)上交易的發(fā)展。
[Abstract]:China's consumer disputes are being staged every day. Every year, the CCTV 3.15 evening party will reveal infringement incidents and counterfeit products related to all aspects of people's clothing, food, housing and transportation. At the same time, people are deeply loathing about illegal businesses. It also showed disappointment in the ability of the government to regulate. Behind the frequent consumption disputes in China, there are still many deficiencies in the remedies of consumer rights. China's consumer rights and interests relief measures include: conciliation, mediation, appeal, arbitration and litigation, these five relief measures each have their own advantages and disadvantages, which can not play a good role in the supervision of the market. For this reason, a large number of businesses are willing to take risks and obtain improper profits through illegal counterfeiting, thus disrupting the normal market economic order. In order to protect the legitimate rights and interests of consumers, maintain a stable market order and find more effective remedies for consumer disputes, it is imperative. Since the beginning of the 20th century, many provinces and cities in China, such as Shandong, Henan, Qingdao and so on, have begun to explore the use of arbitration to resolve consumer disputes, which provides a reference for China to build an arbitration mechanism for consumer disputes. At the same time, other countries in the world, such as the United States, Spain, Portugal and so on, adopted arbitration to settle consumer disputes earlier, the arbitration system of consumer disputes is more perfect, China can absorb advanced foreign ideas and measures. Judging from the current situation of consumer dispute arbitration in China, the main problem is that there is no uniform legislation for consumer dispute arbitration, and the models are different and their own policies, and they fail to give full play to the advantages of the way of consumer dispute arbitration. Therefore, it is imperative to establish a special arbitration mechanism for consumer disputes, which should be conceived as a whole from the aspects of legislation, basic principles, organization construction, starting mode, arbitration procedure and the effectiveness of adjudication. At the same time, in view of the increasing number of online consumption and disputes, the establishment of online consumption dispute arbitration system, through the network to quickly resolve online consumption disputes, will be able to regulate the online trading market, promote the development of online transactions.
