【摘要】：正價(jià)格鑒定意見(jiàn)是刑事司法實(shí)踐中常用的一種證據(jù)類型,在許多財(cái)產(chǎn)犯罪案件中,價(jià)格鑒定意見(jiàn)往往是決定罪與非罪、量刑輕重的關(guān)鍵甚至是唯一標(biāo)準(zhǔn)。因此,價(jià)格鑒定意見(jiàn)的準(zhǔn)確性、客觀性對(duì)于能否正確定罪量刑具有決定意義。但是,在目前的司法實(shí)踐中,刑事案件價(jià)格鑒定中還存在許多問(wèn)題,主要表現(xiàn)為:偵查機(jī)關(guān)在委托鑒定方面存在對(duì)涉案物品
[Abstract]:Positive price appraisal opinion is a kind of evidence commonly used in criminal judicial practice. In many property crime cases, price appraisal opinion is the key or even the only standard to decide the crime and non-crime, and the severity of sentencing. Therefore, the accuracy and objectivity of price appraisal opinion is of decisive significance to the correct conviction and sentencing. However, in the current judicial practice, there are still many problems in the price identification of criminal cases.
