【摘要】：由于技術(shù)偵查措施具有技術(shù)性、秘密性和強制性等特點，，偵查人員運用技術(shù)偵查措施偵查案件時，不可避免地會接觸到當事人的許多隱私。由于我國技術(shù)偵查措施的法律規(guī)制尚不完善，所以極易侵犯當事人的合法隱私。所以，如何完善技術(shù)偵查措施，保護公民的隱私權(quán)，就成為現(xiàn)在亟需解決的問題了。 第一章介紹了隱私權(quán)和技術(shù)偵查的關(guān)系。對隱私權(quán)和技術(shù)偵查做了概括介紹，并把技術(shù)偵查對隱私權(quán)的影響及原因進行了分析。第二章是對技術(shù)偵查立法現(xiàn)狀的概述，并分析了進步與不足之處。第三章介紹了合理隱私期待的由來，并指出保護公民隱私權(quán)的意義和價值。第四章把美國和德國的技術(shù)偵查制度進行了介紹，并對美國和德國在技術(shù)偵查中保護公民隱私權(quán)保護的一些共同點做了總結(jié)。第五章給出了自己對于完善技術(shù)偵查措施制度的一些建議，首先總結(jié)完善技術(shù)偵查必須遵循的一些原則，其次從公民隱私權(quán)保護角度分析如何完善技術(shù)偵查措施。
[Abstract]:Due to the technical, secret and mandatory characteristics of the technical investigation measures, the investigators will inevitably come into contact with a lot of privacy of the parties when they use the technical investigative measures to investigate the cases. Because the legal regulation of technical investigation measures in our country is not perfect, it is easy to violate the legal privacy of the parties. Therefore, how to improve the technical investigation measures and protect citizens' privacy has become an urgent problem. The first chapter introduces the relationship between privacy and technical investigation. This paper gives a general introduction to the right of privacy and technical investigation, and analyzes the influence of technical investigation on the right of privacy and its causes. The second chapter is an overview of the legislative status of technical investigation, and analyzes the progress and shortcomings. Chapter three introduces the origin of reasonable privacy expectation and points out the significance and value of protecting citizens' privacy right. The fourth chapter introduces the system of technical investigation in the United States and Germany, and summarizes some common points of protecting the right to privacy of citizens in the United States and Germany. The fifth chapter gives some suggestions for perfecting the system of technical investigation measures. Firstly, it summarizes some principles that must be followed to perfect the technical investigation measures, and then analyzes how to perfect the technical investigation measures from the perspective of the protection of citizens' right to privacy.
