【摘要】：瑕疵物證、書證是在刑事偵查過程中經(jīng)常出現(xiàn)的情形，其是由于現(xiàn)有法律規(guī)定不完善、偵查人員取證意識不高等多方原因造成的。然而，目前對于該實(shí)務(wù)問題理論界仍然缺乏相對系統(tǒng)的研究，在2010年已經(jīng)頒布實(shí)施的《關(guān)于辦理刑事案件排除非法證據(jù)若干問題的規(guī)定》、《關(guān)于辦理死刑案件審查判斷證據(jù)若干問題的規(guī)定》和2012年新修訂的《中華人民共和國刑事訴訟法》對其規(guī)定也比較寬泛，，以至在具體司法實(shí)踐中對瑕疵物證、書證相關(guān)操作問題仍處于混亂模糊狀態(tài)，從而給司法從業(yè)人員和廣大當(dāng)事人帶來諸多問題。針對司法實(shí)務(wù)界出現(xiàn)的現(xiàn)實(shí)問題，從理論上厘清瑕疵物證、書證的概念、表現(xiàn)形式及法律后果顯得尤為重要；在此基礎(chǔ)上，以實(shí)證分析的方法對國外瑕疵物證、書證的適用情形進(jìn)行歸納評析，以此對比研究我國立法和司法實(shí)踐中瑕疵物證、書證適用中存在的問題；進(jìn)而從證據(jù)能力和證明力的角度對瑕疵物證、書證的證據(jù)評價(jià)詳細(xì)論述，提出經(jīng)驗(yàn)法則和正當(dāng)程序理念在法官評判瑕疵物證、書證中的關(guān)鍵作用；最后對刑事瑕疵物證、書證的補(bǔ)救進(jìn)行系統(tǒng)論述，并對其防范措施提出一些具有實(shí)際操作性的建議。
[Abstract]:Defective material evidence, documentary evidence is a common situation in the process of criminal investigation, which is caused by various reasons, such as imperfect existing laws and regulations, low awareness of collecting evidence among investigators and so on. However, at present, there is still a lack of systematic research in the theoretical circle of this practical issue. In 2010, the regulations on the exclusion of illegal evidence from handling criminal cases were promulgated and implemented. The provisions on the examination and judgment of evidence in death penalty cases and the newly revised Criminal procedure Law of the people's Republic of China in 2012 are also relatively broad, so that defective material evidence is applied in specific judicial practice. The operation problems of documentary evidence are still in a confused state, which brings many problems to the judicial practitioners and the majority of litigants. In view of the practical problems in judicial practice, it is particularly important to clarify the concepts, forms and legal consequences of defective physical evidence, documentary evidence and legal consequences. On this basis, the application of foreign defective material evidence and documentary evidence is summarized and evaluated by the method of empirical analysis, so as to compare and study the problems existing in the application of defective material evidence and documentary evidence in our country's legislation and judicial practice. Then from the point of view of evidence ability and proof power, the paper discusses in detail the evidence evaluation of defective material evidence and documentary evidence, and puts forward the key role of the rule of experience and due process concept in judge judgment of defective material evidence and documentary evidence. Finally, the author systematically discusses the remedy of criminal defective material evidence and documentary evidence, and puts forward some practical suggestions on its preventive measures.
