【摘要】：新《刑事訴訟法》第192條增加了"有專門知識(shí)的人"參與刑事訴訟的條款,這意味著我國(guó)刑事訴訟中確立了專家輔助人制度。專家輔助人出庭對(duì)法官采信鑒定意見(jiàn)具有一定的作用,但實(shí)踐中也面臨一些突出問(wèn)題:專家輔助人的資格條件不明,專家輔助人的對(duì)抗手段有限,專家輔助人出庭的交叉詢問(wèn)不充分等。完善專家輔助人制度應(yīng)合理界定專家輔助人的資格,明確專家輔助人的訴訟地位,明確專家輔助人的意見(jiàn)屬性,解決專家輔助人及技術(shù)服務(wù)機(jī)構(gòu)的管理問(wèn)題。
[Abstract]:Article 192 of the new Code of Criminal procedure adds the clause that "the person with special knowledge" participates in the criminal procedure, which means that the expert assistant system has been established in the criminal procedure in our country. The appearance of expert auxiliaries has a certain effect on the judge's acceptance and appraisal opinion, but in practice there are some outstanding problems: the qualification condition of expert assistant is not clear, and the confrontation means of expert assistant are limited. The cross-examination of expert auxiliaries in court is not sufficient, etc. In order to perfect the system of expert assistant, the qualification of expert assistant should be reasonably defined, the litigation status of expert assistant should be clarified, the opinion attribute of expert assistant should be clear, and the management problems of expert assistant and technical service organization should be solved.
