【摘要】：通過(guò)對(duì)刑事裁判文書中目的解釋的實(shí)踐運(yùn)用研究,表明刑法理論和司法實(shí)踐對(duì)待目的解釋存在明顯的差異。主觀目的解釋與客觀目的解釋的選擇性運(yùn)用,須根據(jù)司法實(shí)踐的具體情況而定。目的解釋不是決定性的解釋方法,各種解釋方法之間也不存在位階性。目的解釋既可以用來(lái)佐證文義解釋和體系解釋的結(jié)論,也可以用來(lái)限定文義解釋結(jié)論的寬泛性。同樣的,體系解釋也可以用來(lái)佐證目的解釋的結(jié)論。刑事裁判文書中目的解釋的運(yùn)用法則呈現(xiàn)多元化的特征。在建構(gòu)目的解釋的司法運(yùn)用規(guī)則時(shí),不宜以目的解釋作為直接根據(jù)認(rèn)定行為的性質(zhì),在刑事裁判文書中應(yīng)敘明規(guī)范目的的識(shí)別方法,并通過(guò)反向論證來(lái)檢驗(yàn)?zāi)康慕忉尩暮侠硇浴?br/>[Abstract]:Through the study of the practice and application of the purpose interpretation in the criminal adjudication document, it is shown that there are obvious differences between the criminal law theory and the judicial practice in the interpretation of the purpose. The selective application of subjective purpose interpretation and objective purpose interpretation must be based on the specific situation of judicial practice. Objective interpretation is not a decisive interpretation method, and there is no hierarchy between various interpretation methods. Objective explanation can be used not only to support the conclusion of textual meaning interpretation and system interpretation, but also to limit the broad nature of textual meaning interpretation conclusion. Similarly, the system explanation can be used to support the conclusion of the purpose explanation. The rules of purpose interpretation in criminal adjudication documents are characterized by diversity. In constructing the rules of judicial application of the interpretation of purpose, it is not appropriate to take the interpretation of purpose as the direct basis of the nature of the act, and to state the identification method of the purpose of the norm in the criminal adjudication document, and to test the rationality of the interpretation of the purpose through the reverse argument.
