【摘要】：哪些檢察工作屬于檢察辦案,是司法責(zé)任制改革深入推進(jìn)的基礎(chǔ)性問題,實(shí)踐中尚存一定分歧�；跈z察辦案主動(dòng)性、個(gè)體獨(dú)立性和措施多樣性的特點(diǎn),在準(zhǔn)確理解檢察辦案運(yùn)行機(jī)制時(shí),很難借鑒其他國家權(quán)力運(yùn)行方式進(jìn)行推導(dǎo)。而只能從檢察辦案運(yùn)行的內(nèi)部軌道出發(fā),歸納不同類別檢察業(yè)務(wù)中檢察辦案運(yùn)行機(jī)制的共同特征來進(jìn)行甄別,包括主體唯一性、行為負(fù)責(zé)性、訴訟程序性、司法親歷性和處理結(jié)論性,并建議將檢察辦案分為辦理案件和監(jiān)督類事項(xiàng),分層級(jí)劃定檢察辦案類型。
[Abstract]:Which procuratorial work belongs to procuratorial handling cases is the basic problem of judicial responsibility system reform, and there are still some differences in practice. Based on the characteristics of procuratorial initiative, individual independence and diversity of measures, it is difficult to draw lessons from the operation mode of other countries when accurately understanding the operation mechanism of procuratorial case handling. But can only proceed from the internal track of the procuratorial case handling operation, sum up the common characteristics of the operation mechanism of the procuratorial case handling in different types of procuratorial business, including the uniqueness of the subject, the responsibility of the behavior, the procedure of litigation. It is suggested that procuratorial cases should be classified into cases and supervision cases, and the types of procuratorial cases should be classified into different levels.
