【摘要】：立法修改和訴訟制度改革都逐步增強了律師執(zhí)業(yè)權利的保障,為實現(xiàn)職務犯罪偵查權與辯護權的動態(tài)平衡,必須對職務犯罪偵辯關系重新審視和理性定位,從傳統(tǒng)的"部分對抗、單向制約"關系轉(zhuǎn)而構建"平衡+協(xié)作"的良性互動關系,平衡是基礎,協(xié)作是補充,平衡中包含對抗和制約,協(xié)作中包含監(jiān)督與促進。應從以下方面著手構建"平衡+協(xié)作"的新型偵辯關系:偵辯雙方增強互信溝通;偵辯雙方建立相互監(jiān)督機制;及時保障律師會見權;有效保障律師救濟權;建立偵查程序證據(jù)有限開示制度;嘗試偵辯交易制度。
[Abstract]:Legislative revision and litigation system reform have gradually strengthened the protection of lawyers' right to practise. In order to realize the dynamic balance between the right to investigate and defend duty crimes, it is necessary to re-examine and rationally position the relationship between the investigation and defense of duty crimes. From the traditional relationship of "partial confrontation, one-way restriction" to "balanced cooperation", the benign interaction relationship is constructed. Balance is the foundation, cooperation is the complement, balance includes confrontation and restriction, and cooperation includes supervision and promotion. The new relationship of "balanced cooperation" should be constructed from the following aspects: enhancing mutual trust and communication between the two sides, establishing mutual supervision mechanism, ensuring the right of lawyers to meet in time, ensuring the right of lawyers to remedy effectively; Establish the system of limited discovery of evidence in investigation procedure and try to deal with investigation and defense.
