【摘要】：刑事訴訟中的新聞輿論監(jiān)督在抑制司法腐敗、宣傳法律及提高公眾的法律意識等方面起到了積極的作用，但是實踐中新聞輿論的不當(dāng)監(jiān)督及法律規(guī)范的缺失，，導(dǎo)致媒介審判、新聞輿論娛樂化等，嚴(yán)重干擾了刑事訴訟的正常進(jìn)行，影響了司法公正與權(quán)威。域外已經(jīng)有了相對完善的防范新聞輿論監(jiān)督對刑事訴訟干擾的措施，我國應(yīng)立足國情，在借鑒域外有益做法的基礎(chǔ)上建構(gòu)新聞輿論監(jiān)督與刑事訴訟和諧關(guān)系，既要加快規(guī)范新聞輿論監(jiān)督的立法，劃分新聞輿論監(jiān)督刑事訴訟的界限，加強(qiáng)新聞界的自律性，擺正媒體的自身定位；也要加強(qiáng)司法機(jī)關(guān)自身建設(shè)，端正對待新聞輿論監(jiān)督的態(tài)度、提高法官應(yīng)對新聞輿論監(jiān)督的能力。
[Abstract]:The supervision of public opinion in criminal proceedings has played a positive role in restraining judicial corruption, propagating the law and raising the public's legal consciousness. However, in practice, the improper supervision of public opinion and the lack of legal norms have led to the trial of the media. Media entertainment seriously interferes with the normal conduct of criminal proceedings and affects judicial justice and authority. There have been relatively perfect measures to prevent interference from the supervision of public opinion on criminal proceedings abroad. China should establish a harmonious relationship between public opinion supervision and criminal proceedings on the basis of reference from the beneficial practices outside the country, so China should base itself on the situation of the country and build a harmonious relationship between public opinion supervision and criminal proceedings. It is necessary not only to speed up the legislation to regulate the supervision of news public opinion, to divide the boundaries of the supervision of news public opinion in criminal proceedings, to strengthen the self-discipline of the press, and to correct the position of the media itself, but also to strengthen the construction of the judicial organs themselves. Correct attitude to press supervision, improve the ability of judges to deal with news public opinion supervision.
