論藏區(qū)賠命價現(xiàn)代化的發(fā)生邏輯

【摘要】：賠命價的復(fù)興是當(dāng)代藏區(qū)刑事法制建設(shè)面臨的難題,此難題是中國刑事法制現(xiàn)代化必須克服的一個環(huán)節(jié)。賠命價的現(xiàn)代化有其自身的發(fā)生邏輯。在現(xiàn)代民族國家的建構(gòu)過程中,中國人選擇的單一制國家體制使藏區(qū)與內(nèi)地省份(或地區(qū))具有相同法律地位的行政單元,而單一制國家體制背后的法制統(tǒng)一原則天然地排斥少數(shù)民族刑事習(xí)慣。國家壟斷刑事司法權(quán)意味著,只有經(jīng)過國家認(rèn)可的少數(shù)民族習(xí)慣規(guī)則中的有益因素才能名正言順的進(jìn)入刑事司法,其他與刑事法制相悖的均在掃除之列。所以,作為藏區(qū)刑事糾紛解決規(guī)則的賠命價習(xí)慣法無法保持其"原生態(tài)"獨立存在于刑事法制之外,需要進(jìn)行現(xiàn)代化改造。
[Abstract]:The revival of compensation price is a difficult problem in the construction of criminal legal system in contemporary Tibetan area, which is a link that must be overcome in the modernization of China's criminal legal system. The modernization of loss price has its own logic. In the process of constructing a modern nation-state, the Chinese chose a single system of state system to make the Tibetan region have the same legal status as the inland provinces (or regions). The principle of unity of legal system behind the unitary state system naturally excludes the criminal customs of ethnic minorities. The state monopoly of criminal jurisdiction means that only the beneficial factors in the customary rules of ethnic minorities that have been approved by the state can enter the criminal justice in a proper way, and the others that are contrary to the criminal legal system are all swept away. Therefore, as the criminal dispute settlement rules in Tibetan area, the customary law of compensation price can not keep its "original ecology" independent from the criminal legal system, so it needs to be modernized.
