【摘要】：為促進(jìn)量刑均衡與公正,在大力推進(jìn)量刑規(guī)范化改革的同時,應(yīng)當(dāng)積極構(gòu)建以實(shí)體控制與程序制約為實(shí)現(xiàn)路徑的量刑監(jiān)督制度。在實(shí)體控制上,充分發(fā)揮檢察機(jī)關(guān)在制定量刑實(shí)體標(biāo)準(zhǔn)、強(qiáng)化量刑信息收集、完善量刑建議中的職能作用;在程序制約上,落實(shí)相對獨(dú)立量刑程序,引入類案監(jiān)督理念,強(qiáng)化過程監(jiān)督,創(chuàng)建體系化的量刑監(jiān)督制度。
[Abstract]:In order to promote the balance and justice of sentencing, we should actively construct the sentencing supervision system which takes substantive control and procedural restriction as the way to realize the reform of sentencing standardization. In the aspect of entity control, the procuratorial organ should give full play to the function of procuratorial organ in formulating the standard of sentencing entity, strengthening the collection of sentencing information, perfecting the function of sentencing suggestion, implementing the relatively independent sentencing procedure and introducing the concept of case supervision. Strengthen the process supervision and establish a systematic sentencing supervision system.
