派駐基層檢察室建設(shè)和發(fā)展的研究

【摘要】：派駐基層檢察室是基層政法機(jī)關(guān)的重要組成部分,是檢察機(jī)關(guān)司法屬性和工作職能的自然延伸,也是全面加速基層管理法治化之中的核心力量。加速有關(guān)基層檢察室的具體構(gòu)建以及發(fā)展,屬于完善法律服務(wù)體系,是促進(jìn)檢力下沉的重要載體和有效方式,是強(qiáng)化法律監(jiān)督職能、深入推進(jìn)法治建設(shè)工作、更好地服務(wù)大局、服務(wù)人民群眾、服務(wù)社區(qū)建設(shè)的客觀需要,是完善中國特色社會主義檢察制度、達(dá)成檢察機(jī)關(guān)高效成長的必定要求。加強(qiáng)配套的基層檢察室的建設(shè)和發(fā)展,有利于維護(hù)基層社會和諧穩(wěn)定,有利于促進(jìn)基層廉政建設(shè),有利于保障基本公共服務(wù)均等化,是化解基層社會矛盾、維護(hù)穩(wěn)定的需要,具有十分重要的現(xiàn)實意義。近年來,在最高人民檢察院的明文規(guī)定和大力支持下,派駐基層檢察室在各個地區(qū)之中獲得了良好的發(fā)展。廣東地區(qū)有關(guān)檢察室的建設(shè)以及各項推進(jìn)工作,均走在全國前列。本文通過對廣東地區(qū)派駐基層檢察室進(jìn)行實地考察調(diào)研,收集數(shù)據(jù)、采樣具體案例,特別是對廣東地區(qū)派駐基層檢察室最為突出的四種創(chuàng)新模式進(jìn)行實證分析。從實地案例及數(shù)據(jù)來看,盡管試點地區(qū)改革取得了豐碩的成果,派駐基層檢察室的組織體系和管轄制度都已具雛形,工作職能在推進(jìn)基層法治建設(shè)、創(chuàng)新發(fā)展社區(qū)管理、維護(hù)社會穩(wěn)定等方面頗具成效,但也存在不少問題。從宏觀上看,派駐基層檢察室的總體發(fā)展仍存在檢察理論研究不深、法律地位薄弱、未能完整體現(xiàn)檢察院職能定位,同時配套機(jī)制不完善、管理運(yùn)轉(zhuǎn)不順暢等問題也成為制約其發(fā)展的因素。這些問題源自派駐基層檢察室法律地位與建制不明、立法授權(quán)缺失等深層次原因。筆者認(rèn)為,要進(jìn)一步促進(jìn)派駐基層檢察室的發(fā)展和建設(shè),鞏固和完善試點地區(qū)的成果和經(jīng)驗,需要解決深層體制性局限問題,同時發(fā)展和完善相對應(yīng)的機(jī)制建構(gòu)、職能定位、隊伍建設(shè)等配套建設(shè),以此推進(jìn)派駐基層檢察室未來的建設(shè)和發(fā)展。
[Abstract]:The stationing of procuratorial offices at the grass-roots level is an important part of the political and legal organs at the grass-roots level, a natural extension of the judicial attributes and work functions of the procuratorial organs, and a core force in the process of speeding up the rule of law in the management of grass-roots units in an all-round way. Speeding up the concrete construction and development of the procuratorial offices at the grass-roots level belongs to the perfection of the legal service system, is an important carrier and an effective way to promote the sinking of the procuratorial force, is to strengthen the function of legal supervision, to advance the construction of the rule of law in depth, and to better serve the overall situation. It is necessary to perfect the socialist procuratorial system with Chinese characteristics and to achieve the efficient growth of procuratorial organs. Strengthening the construction and development of supporting procuratorial offices at the grass-roots level is conducive to maintaining social harmony and stability at the grass-roots level, promoting the building of a clean and honest government at the grass-roots level, ensuring equalization of basic public services, and is the need to resolve social contradictions at the grass-roots level and maintain stability. It has very important practical significance. In recent years, with the explicit regulations and strong support of the Supreme people's Procuratorate, the grass-roots procuratorial offices have achieved good development in various regions. Guangdong area concerned procuratorial office construction and each promotion work, all walks in the national front row. Based on the field investigation and investigation of the grass-roots procuratorial offices in Guangdong, this paper collects data and samples specific cases, especially the empirical analysis of the four most prominent innovation modes of the grass-roots procuratorial offices in Guangdong. Judging from the field cases and data, despite the fruitful results achieved in the reform of the pilot areas, the organizational system and the jurisdiction system attached to the procuratorial offices at the grass-roots level have taken shape, and their work functions are to promote the construction of the grass-roots rule of law and to innovate and develop community management. The maintenance of social stability and other aspects are quite effective, but there are also many problems. From the macro point of view, the overall development of the procuratorial offices at the grass-roots level still exists that the procuratorial theory is not deeply studied, the legal status is weak, the functions of the procuratorates are not fully reflected, and the supporting mechanism is not perfect. Problems such as the unsmooth operation of management have also become the factors restricting its development. These problems arise from the legal status and system of the basic procuratorial office, the lack of legislative authorization and other deep-seated reasons. The author believes that in order to further promote the development and construction of the procuratorial offices stationed at the grass-roots level, consolidate and perfect the achievements and experiences of the pilot areas, we need to solve the problem of deep institutional limitations, and at the same time develop and improve the corresponding mechanism construction and functional orientation. Team construction and other supporting construction to promote the future construction and development of procuratorial offices stationed at the grass-roots level.
