【摘要】：當(dāng)前,網(wǎng)上仲裁的發(fā)展還處于初級(jí)階段,存在很多的問(wèn)題。面對(duì)當(dāng)前的困局,應(yīng)采取更加寬容的態(tài)度,完善相關(guān)法律和制度。對(duì)網(wǎng)上仲裁協(xié)議的"書面要求"做擴(kuò)大解釋;充分利用現(xiàn)代科技技術(shù),完善網(wǎng)上仲裁程序,增加其安全性和可靠性;增加當(dāng)事人或仲裁員的自由選擇,以更靈活的方式確定網(wǎng)上仲裁地;對(duì)于法律適用問(wèn)題的解決,應(yīng)該更加注重當(dāng)事人意思自治原則的應(yīng)用;而仲裁裁決的執(zhí)行方面,應(yīng)采取符合國(guó)際商事仲裁發(fā)展趨勢(shì)的態(tài)度,制定法規(guī),使網(wǎng)上仲裁裁決的執(zhí)行更加規(guī)范。
[Abstract]:At present, the development of online arbitration is still in its infancy, and there are many problems. Faced with the current difficulties, we should adopt a more tolerant attitude and improve relevant laws and systems. In order to solve the problem of law application, we should pay more attention to the application of the principle of Party autonomy; and in the execution of arbitral awards, we should adopt an attitude in line with the development trend of international commercial arbitration, formulate laws and regulations, so that the online arbitral awards can be carried out. The line is more standardized.
