【摘要】：被告人與被害人的訴訟地位,隨著時(shí)代的更替呈現(xiàn)出完全不同的發(fā)展軌跡,實(shí)現(xiàn)雙方的權(quán)利平衡是刑事訴訟演進(jìn)的必然規(guī)律。本文聚焦未成年人刑事案件領(lǐng)域,就這一問(wèn)題展開論述。從未成年被害人與被告人權(quán)利現(xiàn)狀分析入手,總結(jié)了B市法院未成年被害人刑事案件的基本情況。從參與性訴訟權(quán)利、保障性訴訟權(quán)利、救濟(jì)性訴訟權(quán)利和配套措施等方面,具體分析了未成年被害人與被告人權(quán)利失衡的表征和改善路徑。
[Abstract]:The litigation status of the accused and the victim shows a completely different development track with the change of the times, and the realization of the balance of the rights of the two sides is the inevitable law of the evolution of the criminal procedure. This paper focuses on the field of juvenile criminal cases and discusses this issue. The present situation of the rights of the injured and the accused has been analyzed, and B is summarized. The basic situation of the criminal cases of the minor victims in the city court, from the aspects of the rights of participating litigation, the rights of the litigations, the rights of the relief litigation and the supporting measures, analyses the representation and improvement path of the unbalance of the rights of the minor victims and the accused.
