【摘要】：我國目前還沒有建立一套完整的輕罪制度,輕微刑事案件的處理缺乏專門的法律制度來支撐和引導(dǎo),如果所有案件都利用刑事訴訟法中的程序進行,不僅無法實現(xiàn)輕微刑事案件迅速處理的要求,而且會降低司法效率、浪費司法資源。所以,我國在刑事案件處理問題上的當(dāng)務(wù)之急是探索一條符合輕微刑事案件的訴訟程序,在保障權(quán)利的前提下快速辦理輕微刑事案件,更有效地優(yōu)化司法資源配置。2014年我國出臺相關(guān)規(guī)定,明確將輕微刑事案件速裁程序確立試點城市,將案件進行繁簡分流,簡化相關(guān)步驟,并在庭審過程中省略相應(yīng)環(huán)節(jié)。筆者認為,司法機關(guān)應(yīng)當(dāng)在尊重當(dāng)事人選擇權(quán)的前提下,結(jié)合國外立法與司法來探索出適合我國國情、具有現(xiàn)實可行性的輕微刑事案件速裁程序。本文立足于我國當(dāng)前國情,在分析我國構(gòu)建輕微刑事案件速裁程序現(xiàn)有制度的基礎(chǔ)上,對我國輕微刑事案件速裁程序的構(gòu)建提出了一些具體的意見和建議。本文介紹了我國輕微刑事案件速裁程序的概念,與其他案件的界限,以及程序本身的特點。羅列我國目前輕微刑事案件速裁程序的實施現(xiàn)狀,列舉域外相關(guān)程序的法律制度,并根據(jù)我國速裁程序的特點總結(jié)從國外相關(guān)程序取得的經(jīng)驗,筆者針對目前出現(xiàn)的不足,對我國輕微刑事案件速裁程序提出一些相關(guān)建議,希望此文能夠?qū)δ壳八痉▽嵺`以及日后的改進提供一定的參考。
[Abstract]:At present, China has not established a complete system of misdemeanours, and the handling of minor criminal cases lacks a special legal system to support and guide them. If all cases are carried out using the procedures in the Criminal procedure Law, It can not only fail to meet the requirement of prompt handling of minor criminal cases, but also reduce judicial efficiency and waste judicial resources. Therefore, the urgent task of our country in handling criminal cases is to explore a procedure that conforms to minor criminal cases, and to deal with minor criminal cases quickly under the premise of safeguarding their rights. More effectively optimize the allocation of judicial resources. In 2014, our country issued relevant regulations, clearly established the trial city of minor criminal cases, simplified the relevant steps, and omitted the corresponding links in the trial process. The author believes that the judicial organs should, on the premise of respecting the right of the parties to choose, combine with foreign legislation and judicature to explore the procedure of quick adjudication of minor criminal cases which is suitable for the national conditions of our country and has practical feasibility. Based on the current situation of our country and on the basis of analyzing the existing system of the quick adjudication procedure of minor criminal cases in our country, this paper puts forward some concrete opinions and suggestions on the construction of the speedy adjudication procedure of minor criminal cases in our country. This paper introduces the concept of quick adjudication procedure of minor criminal cases in our country, the boundary with other cases, and the characteristics of the procedure itself. This paper lists the status quo of the implementation of the expedited adjudication procedure in minor criminal cases in our country, enumerates the legal system of the extraterritorial related procedure, and sums up the experience gained from the relevant foreign procedures according to the characteristics of the expedited adjudication procedure in our country. This paper puts forward some relevant suggestions on the speedy adjudication procedure of minor criminal cases in our country, and hopes that this article can provide some reference for the present judicial practice and the future improvement.
