【摘要】：新《刑事訴訟法》的修訂實(shí)施，第一次從立法層面正式確立檢察機(jī)關(guān)刑罰變更執(zhí)行同步監(jiān)督制度。檢察機(jī)關(guān)不斷加強(qiáng)對(duì)刑罰變更執(zhí)行的同步監(jiān)督，對(duì)于確保國(guó)家法律的統(tǒng)一實(shí)施，規(guī)范刑罰變更執(zhí)行活動(dòng)，維護(hù)刑事判決裁定的嚴(yán)肅性、穩(wěn)定性和公正性具有十分重要的意義。 本文解析了刑罰變更執(zhí)行同步監(jiān)督的概念和內(nèi)涵，分析了刑罰變更執(zhí)行同步監(jiān)督的理論基礎(chǔ)和現(xiàn)實(shí)意義，并對(duì)國(guó)外的刑罰變更執(zhí)行監(jiān)督制度進(jìn)行了比較考察，，闡述了我國(guó)刑罰變更執(zhí)行同步監(jiān)督的現(xiàn)狀及存在的問題，并提出了完善我國(guó)刑罰變更執(zhí)行同步監(jiān)督制度的一些具體建議。全文分為四個(gè)部分： 第一部分是基礎(chǔ)部分。這一部分闡述刑罰變更執(zhí)行同步監(jiān)督的概念、內(nèi)涵、理論基礎(chǔ)和現(xiàn)實(shí)意義，為下文具體分析實(shí)踐中刑罰變更執(zhí)行同步監(jiān)督工作中存在的問題做鋪墊。 第二部分是比較部分。這一部分首先介紹國(guó)外的刑罰變更執(zhí)行監(jiān)督模式，然后比較我國(guó)同步監(jiān)督模式與國(guó)外監(jiān)督的異同。 第三部分是分析部分。這一部分首先介紹我國(guó)刑罰變更執(zhí)行同步監(jiān)督的實(shí)踐做法，然后著重分析同步監(jiān)督存在的問題。 第四部分是完善部分。針對(duì)存在的問題，提出自己對(duì)于完善刑罰變更執(zhí)行同步監(jiān)督制度的建議。
[Abstract]:The revision and implementation of the new Criminal procedure Law, for the first time, formally establishes the system of simultaneous supervision of the procuratorial organs' penalty change and execution from the legislative level. It is of great significance for the procuratorial organ to strengthen the synchronous supervision of the execution of the penalty change in order to ensure the uniform implementation of the national law, to standardize the execution of the penalty change, to maintain the seriousness, stability and impartiality of the criminal judgment and ruling. This paper analyzes the concept and connotation of synchronous supervision of penalty change execution, analyzes the theoretical basis and practical significance of synchronous supervision of penalty change execution, and makes a comparative study on the supervision system of penalty change execution abroad. This paper expounds the present situation and existing problems of the synchronous supervision of the execution of penalty change in our country, and puts forward some concrete suggestions on how to perfect the system of synchronous supervision of the execution of the change of punishment in our country. The paper is divided into four parts: the first part is the basic part. This part expounds the concept, connotation, theoretical basis and practical significance of the synchronous supervision of the execution of penalty change, which paves the way for the following concrete analysis of the problems existing in the practice of the synchronous supervision of the execution of the penalty change. The second part is the comparative part. This part first introduces the mode of execution supervision of penalty change in foreign countries, and then compares the similarities and differences between China's synchronous supervision mode and foreign supervision mode. The third part is the analysis part. This part first introduces the practice of synchronous supervision of penalty change in our country, and then analyzes the problems existing in synchronous supervision. The fourth part is the perfect part. In view of the existing problems, the author puts forward his own suggestions for perfecting the synchronous supervision system of penalty change execution.
