行政訴訟受案范圍的拓展

【摘要】:行政訴訟受案范圍是指人民法院受理行政案件的范圍。哪些行政行為具有可訴性,,直接關(guān)乎到公民權(quán)的救濟(jì)以及司法權(quán)對(duì)行政權(quán)的監(jiān)督范圍。 根據(jù)目前我國(guó)《行政訴訟法》和相關(guān)司法解釋的規(guī)定,我國(guó)行政訴訟受案范圍采用的是混合式立法模式劃定受案范圍。首先以概括式作出原則性規(guī)定,再采用肯定式和否定式列舉作出具體規(guī)定。這種模式在邏輯上違反了排中律的原則,造成了法官適用法律時(shí)猶豫不決。在借鑒國(guó)外先進(jìn)國(guó)家關(guān)于受案范圍的規(guī)定下,本人認(rèn)為,行政訴訟受案范圍不應(yīng)當(dāng)局限在具體行政行為的合法性審查方面,合理性審查也很有必要。此外,把抽象行政行為、內(nèi)部行政行為、行政自由裁量行政行為、行政事實(shí)行為等幾種行政行為列入可訴性行政行為的范圍,對(duì)于擴(kuò)大行政訴訟受案范圍意義重大。對(duì)行政相對(duì)人的權(quán)益的保護(hù),不能僅僅停留在“人身權(quán)、財(cái)產(chǎn)權(quán)”,憲法賦予的各種公民政治權(quán)利,例如教育權(quán)、休息權(quán)等,都應(yīng)當(dāng)收到司法保護(hù)。只有這樣,才能從根本上徹底解決行政訴訟受案范圍過(guò)窄的問(wèn)題,充分有效的給行政相對(duì)人提供司法救濟(jì)。 考慮到我國(guó)法制建設(shè)的現(xiàn)實(shí)狀況,擴(kuò)大受案范圍不是無(wú)限制的擴(kuò)大,本文適時(shí)的提出了擴(kuò)大行政訴訟受案范圍的界限。
[Abstract]:The scope of accepting cases in administrative proceedings refers to the scope of administrative cases accepted by the people's courts. Which administrative acts are actionable, directly related to the relief of civil rights and the scope of judicial supervision of administrative power. According to the provisions of Administrative procedure Law and related judicial interpretation, the range of administrative litigation cases in our country is defined by mixed legislative model. First of all, generalize the rules of principle, then use the positive and negative enumeration to make specific provisions. This pattern logically violates the principle of exclusion, causing judges to hesitate to apply the law. In the light of the provisions of foreign advanced countries on the scope of accepting cases, I believe that the scope of accepting cases in administrative proceedings should not be limited to the examination of the legality of specific administrative acts, and the examination of reasonableness is also very necessary. In addition, it is of great significance to include abstract administrative acts, internal administrative acts, administrative discretionary administrative acts, administrative factual acts and other administrative acts in the scope of actionable administrative acts. The protection of the rights and interests of the administrative counterpart should not only be confined to "personal rights, property rights", and all kinds of civil and political rights, such as the right to education and the right to rest, which are conferred by the Constitution, should all receive judicial protection. Only in this way can we solve the problem of too narrow range of cases in administrative litigation and provide judicial relief to administrative counterpart. Considering the reality of legal system construction in our country, expanding the scope of accepting a case is not an unlimited expansion, this paper puts forward the limits of expanding the scope of accepting a case in administrative litigation.
