【摘要】：刑事司法鑒定是一個國家或地區(qū)刑事訴訟制度的重要組成部分，它在準確、有效地查明案件事實，，正確適用法律，保障及時裁判和公正司法方面發(fā)揮著不可替代的重要作用。臺灣地區(qū)的《刑事訴訟法》有關司法鑒定的規(guī)定，內容較為全面，規(guī)定較為細致，有不少值得稱道之處，但也并非完美無缺。本文在闡釋臺灣地區(qū)刑事司法鑒定制度主要內容的基礎上，對其進行客觀評價，并就其對大陸地區(qū)刑事司法鑒定制度的發(fā)展與完善所應具有的借鑒意義進行初步的探討。
[Abstract]:Criminal judicial identification is an important part of criminal procedure system in a country or region. It plays an irreplaceable role in finding out the facts of a case accurately and effectively, applying the law correctly and ensuring the timely adjudication and fair administration of justice. The provisions of the Criminal procedure Law in Taiwan concerning judicial expertise are relatively comprehensive and detailed, and there are many laudable points, but they are not perfect. On the basis of explaining the main contents of criminal judicial identification system in Taiwan, this paper makes an objective evaluation of it, and makes a preliminary discussion on its reference significance for the development and perfection of criminal judicial appraisal system in mainland China.
