【摘要】：隨著DNA生物技術(shù)的發(fā)展,在刑事偵查中運(yùn)用大規(guī)模抽血比對(duì)措施已成為一種重要的偵查方法。但在我國(guó)現(xiàn)行《刑事訴訟法》體系下,偵查機(jī)關(guān)采取此種措施并沒(méi)有充足的法律授權(quán)依據(jù)。在我國(guó)《刑事訴訟法》未建立第三人人身檢查和集體檢查制度之前,偵查機(jī)關(guān)欲正當(dāng)化大規(guī)模抽血比對(duì)措施的運(yùn)用,應(yīng)在執(zhí)行過(guò)程中主動(dòng)、切實(shí)、精細(xì)地落實(shí)同意機(jī)制方為合法。
[Abstract]:With the development of DNA biotechnology, the use of large-scale blood sampling has become an important investigation method in criminal investigation. However, under the current system of criminal procedure law of China, the investigation organs do not have sufficient legal authority to take such measures. In China, the criminal litigation law of China has not established third physical examination and physical examination. Before the system is checked, the application of the measures for the comparison of large-scale blood extraction by the investigative organs should be taken in the course of the implementation, and the implementation of the consent mechanism is legitimate.
