【摘要】：裁判文書網(wǎng)上公開的保障機(jī)制包括公眾查閱保障機(jī)制、當(dāng)事人信息保障機(jī)制和法院組織保障機(jī)制三個方面。通過以H省三級法院為樣本的調(diào)研發(fā)現(xiàn),實踐中裁判文書網(wǎng)上公開保障機(jī)制存在文書查閱范圍限縮、文書查閱時間延遲、當(dāng)事人信息保護(hù)尺度不一、當(dāng)事人信息保護(hù)措施不力和法院組織機(jī)構(gòu)的設(shè)置不合理等問題。有必要通過增強(qiáng)對文書上網(wǎng)積極意義的認(rèn)識,提升公眾查閱文書的效果,完善相關(guān)立法,采用科學(xué)合理的考核方法和改革法院文書上網(wǎng)管理機(jī)構(gòu)等舉措,促進(jìn)裁判文書網(wǎng)上公開保障機(jī)制的完善。
[Abstract]:The safeguard mechanism of online publication of judgment documents includes three aspects: public access safeguard mechanism, party information safeguard mechanism and court organization safeguard mechanism. Through the investigation and investigation of three levels of courts in H province, it is found that in practice, the online public safeguard mechanism of adjudicative documents has the limitation of the scope of access to documents, the delay of access time of documents, and the different standards of information protection of the parties. The information protection measures of the parties are weak and the setting of the court organization is unreasonable and so on. It is necessary to enhance the understanding of the positive significance of online access to documents, enhance the effectiveness of public access to documents, improve relevant legislation, adopt scientific and reasonable assessment methods, and reform the administration of court documents online, and so on. To promote the improvement of online public protection mechanism for adjudicative documents.
