【摘要】：執(zhí)行力的正當性基礎有別于既判力,正當程序保障下的自我歸責原則作為既判力的正當性基礎,僅能成為賦予生效法律文書以執(zhí)行力的不充分且不必要條件。已經正當程序保障的確定債權,因不存在再事爭議的常規(guī)救濟途徑,具備賦予執(zhí)行力的正當性基礎。雖未經正當程序保障但當事人對債權不存在實質性爭議的推定債權,因債權成立且合法具有高度蓋然性,在保留必要后置性程序保障的基礎上,具備賦予其強制執(zhí)行力的正當性基礎。鑒于我國缺乏執(zhí)行文與債務人異議之訴制度,執(zhí)行力的賦予、消減及其與禁訴效力之間的關系均不能簡單套用德日相關規(guī)定,而有必要予以深入檢討。
[Abstract]:The justifiable basis of executive power is different from the res judicata. The principle of self imputation under the guarantee of due process is the basis for the justification of the res judicata, and it can only be an inadequate and unnecessary condition for the enforcement of the effective legal instrument. The justifiable basis of executive power. Although the presumption claims of the parties do not have substantial disputes over the creditor's rights without due process, the creditor's claim is established and legally has a high degree of probability. On the basis of preserving the necessary postposition guarantee, it has a positive basis for endowing its enforcement power. In view of the lack of implementation of the text and debtor in our country The relationship between the dissenting complaint system, the executive power, the reduction and the effect of the prohibition of prosecution can not be simply applied to the relevant provisions of Germany and Japan, but it is necessary to review it in depth.
