【摘要】：黨的十八大以來,國內政治風氣轉變,中央對公正司法日益重視,案件的申訴率和再審率與之前形成鮮明對比。法治社會逐步建立的時代背景和反腐推動,為案件申訴、律師代理提供了可能。律師的專業(yè)性、團隊力和協(xié)調性等特點,使申訴代理案件有較高成功率。同時,申訴案件的復雜性使申訴人離不開律師的幫助,律師更是司法機關糾正錯案的重要依靠力量。逐步建立申訴案件律師代理制度,除借鑒域外和我國臺灣地區(qū)的成功經驗,更要結合當前的司法實踐,在實體和程序上解決律師代理申訴案件的制約難題。
[Abstract]:Since the 18th National Congress of the Party, the domestic political atmosphere has changed, the central government has paid more and more attention to the impartial administration of justice, and the appeal rate and retrial rate of cases are in sharp contrast with the previous cases. The background of the gradual establishment of the rule of law society and the promotion of anti-corruption provide the possibility for the appeal of cases and the representation of lawyers. Lawyer's professional, team strength and coordination, so that the complaint representation cases have a high success rate. At the same time, the complexity of the complaint case makes the complainant inseparable from the help of the lawyer, who is an important force for the judiciary to correct the wrong case. In order to set up the lawyer's representation system of complaint cases step by step, we should not only learn from the successful experiences of foreign countries and Taiwan area, but also solve the restriction problems of lawyers' representation cases in entity and procedure in combination with the current judicial practice.
