【摘要】：2012年我國(guó)全國(guó)人大常委會(huì)修改并通過(guò)了新《民事訴訟法》，并在第56條增設(shè)了第3款即第三人撤銷之訴的規(guī)定，為救濟(jì)第三人權(quán)利提供了另一可行的途徑。該制度作為一種特殊的救濟(jì)制度具有補(bǔ)充性和變更性的特點(diǎn)，并且與我國(guó)之前的設(shè)立的訴訟第三人制度、案外人執(zhí)行異議制度以及第三人申請(qǐng)?jiān)賹徶贫刃纬梢惶紫到y(tǒng)的第三人權(quán)利保護(hù)制度。通過(guò)結(jié)合其他國(guó)家和地區(qū)的立法實(shí)踐比較，進(jìn)而實(shí)現(xiàn)對(duì)第三人撤銷之訴法理上的性質(zhì)分析，，并結(jié)合具體案例比較分析與我國(guó)其他相關(guān)訴訟制度以及我國(guó)臺(tái)灣地區(qū)的相關(guān)制度的異同點(diǎn)來(lái)更好了解我國(guó)的第三人撤銷之訴制度，同時(shí)理清第三人撤銷之訴的適用范圍以及邊界，積極探索我國(guó)的第三人撤銷之訴制度程序構(gòu)建理念。
[Abstract]:In 2012, the standing Committee of the National people's Congress amended and adopted the new Civil procedure Law, and added the provision of the third paragraph (the third party's revocation action) in Article 56, which provides another feasible way for the relief of the third party's rights. As a special relief system, this system has the characteristics of supplement and alteration, and it is similar to the third party system of litigation established before our country. The dissent system and the third party application retrial system form a systematic system of protecting the rights of the third party. By comparing the legislative practice of other countries and regions, the author analyzes the nature of the legal theory of the third party's revocation. And by comparing the specific cases with other relevant litigation systems in China and the relevant systems in Taiwan, we can better understand the system of third party revocation in our country. At the same time, it clarifies the scope of application and the boundary of the revocation of the third party, and actively explores the construction idea of the procedure of the revocation of the third party in our country.
