【摘要】:刑罰的執(zhí)行是國(guó)家授權(quán)的專門機(jī)構(gòu)將法院判決所確定的刑罰付諸實(shí)施的活動(dòng),刑罰執(zhí)行監(jiān)督是指人民檢察院對(duì)刑罰執(zhí)行機(jī)關(guān)執(zhí)行人民法院已經(jīng)發(fā)生法律效力的刑事判決、裁定的活動(dòng)所實(shí)行的法律監(jiān)督!吨腥A人民共和國(guó)憲法》第129條明確規(guī)定:“中華人民共和國(guó)人民檢察院是國(guó)家法律監(jiān)督機(jī)關(guān)”。從根本上規(guī)定了在我國(guó)人民檢察院是我國(guó)的刑罰執(zhí)行監(jiān)督機(jī)關(guān)。從中外法制史上看,法律監(jiān)督理論、分權(quán)制衡理論、人權(quán)保障理論又從不同側(cè)面為刑罰執(zhí)行監(jiān)督奠定了堅(jiān)實(shí)的理論基礎(chǔ)。當(dāng)前,我國(guó)刑罰執(zhí)行監(jiān)督存在著執(zhí)行監(jiān)督法律不完善,執(zhí)行監(jiān)督機(jī)構(gòu)設(shè)置失當(dāng),刑罰執(zhí)行交付、刑罰執(zhí)行變更與刑罰執(zhí)行過(guò)程難以監(jiān)督,以及刑罰執(zhí)行監(jiān)督方式過(guò)簡(jiǎn)等問(wèn)題,使得對(duì)各類刑罰執(zhí)行的方式、力度和尺寸的把握并不十分到位,而檢察機(jī)關(guān)的監(jiān)督不足甚至缺失,更是使刑罰執(zhí)行形成了一些難題和死角。極易引發(fā)違法侵權(quán)、執(zhí)行偏差等問(wèn)題的產(chǎn)生。以上這些問(wèn)題僅靠執(zhí)行主體的自身糾正和防范是遠(yuǎn)遠(yuǎn)不夠的,應(yīng)該在國(guó)家的統(tǒng)一規(guī)劃下,加強(qiáng)立法保障,建立完善的刑罰執(zhí)行監(jiān)督體系,注重刑罰執(zhí)行監(jiān)督的功能發(fā)揮和監(jiān)督機(jī)制的創(chuàng)新。具體而言,應(yīng)以立法為先導(dǎo),以規(guī)范檢察機(jī)關(guān)建設(shè)為基礎(chǔ),以提高檢察人員的素質(zhì)、建立責(zé)任制為保障,從而強(qiáng)化監(jiān)督,促進(jìn)公正執(zhí)法、文明執(zhí)法、廉潔執(zhí)法,保證刑罰正確執(zhí)行,維護(hù)國(guó)家法律統(tǒng)一正確實(shí)施。完善刑罰執(zhí)行監(jiān)督立法,應(yīng)當(dāng)強(qiáng)化檢察機(jī)關(guān)發(fā)現(xiàn)違法的功能,加強(qiáng)對(duì)于刑罰執(zhí)行的實(shí)體和程序?qū)彶?完善審查機(jī)制,在明確現(xiàn)有的發(fā)現(xiàn)違法的途徑的同時(shí),應(yīng)當(dāng)明確檢察機(jī)關(guān)的隨時(shí)介入制度,最終達(dá)到強(qiáng)化檢察機(jī)關(guān)糾正違法及預(yù)防職務(wù)犯罪的功能的目的。規(guī)范派駐檢察室的建設(shè),要完善檢查機(jī)關(guān)機(jī)構(gòu)設(shè)置,提升相關(guān)派駐檢察機(jī)關(guān)地位,配備充足的人員、物質(zhì)裝備,提高必要的生活補(bǔ)貼、特殊崗位津貼,應(yīng)建立相應(yīng)的工作制度及實(shí)行等級(jí)評(píng)定,加強(qiáng)檢察人員的培訓(xùn),提高檢察人員的素質(zhì)。最終形成、建立刑事執(zhí)行監(jiān)督責(zé)任制。
[Abstract]:The execution of penalty is the activity of the specialized institution authorized by the state to put into practice the penalty determined by the court judgment. The supervision of penalty execution means that the people's procuratorate carries out the criminal judgment of the people's court which has the legal effect on the execution of the penalty executing organ. Article 129 of the Constitution of the people's Republic of China clearly states that "the people's Procuratorate of the people's Republic of China is the state legal supervisory organ". The basic stipulation in our country people's procuratorate is our country's penalty execution superintendence organ. From the history of Chinese and foreign legal system, the theory of legal supervision, the theory of separation of powers and checks and balances, and the theory of human rights protection have laid a solid theoretical foundation for the supervision of penalty execution from different aspects. At present, there are some problems in the supervision of the execution of penalty in our country, such as the imperfection of the law on the supervision of the execution of the penalty, the improper setting of the supervisory organ for the execution of the penalty, the delivery of the execution of the penalty, the difficulty in supervising the change of the execution of the penalty and the process of the execution So that the execution of all kinds of penalties, the strength and size of the grasp is not very in place, and the procuratorial organs of inadequate or even lack of supervision, but also make the execution of penalties to form a number of problems and corner. It is easy to cause illegal infringement, execution deviation and other problems. It is far from enough to rely only on the self-correction and prevention of the main body of execution. Under the unified plan of the state, we should strengthen the legislative guarantee and establish a sound system of supervision over the execution of penalties. Pay attention to the function of penalty execution supervision and innovation of supervision mechanism. Specifically, we should take legislation as the guide, standardize the construction of procuratorial organs as the basis, improve the quality of procuratorial personnel and establish a responsibility system as a guarantee, thus strengthening supervision, promoting fair law enforcement, civilized law enforcement, and clean law enforcement. To ensure the correct execution of penalties and to safeguard the unified and correct implementation of national laws. In order to improve the legislation on the supervision of penalty execution, we should strengthen the function of procuratorial organs in discovering violations of the law, strengthen the examination of entities and procedures for the execution of penalties, improve the examination mechanism, and at the same time clarify the existing ways of discovering violations of the law. It is necessary to clarify the system of procuratorial organ's intervention at any time, and finally to strengthen the function of procuratorial organ to correct illegality and prevent duty crime. To standardize the construction of procuratorial offices, it is necessary to improve the establishment of inspection organs, upgrade the status of relevant procuratorial organs, equip them with sufficient personnel and material equipment, and increase necessary living allowances and special post allowances. It is necessary to establish the corresponding working system and grade evaluation, strengthen the training of procuratorial personnel and improve the quality of procuratorial personnel. The final formation, the establishment of the criminal executive supervision responsibility system.
