【摘要】：犯罪記錄封存制度應(yīng)當(dāng)滿足幫助犯罪未成年人"去標(biāo)簽化"與"再社會化"以及維護(hù)社會的安定與和諧的要求。我國現(xiàn)行的未成年人犯罪記錄封存制度存在犯罪信息不當(dāng)泄露、未成年人就業(yè)受限、融入社會困難、封存范圍過于僵硬等問題。以雙向保護(hù)理念為視角,從信息保護(hù)、從業(yè)禁止、封存范圍等方面設(shè)想制度完善的合理路徑,以期使犯罪記錄封存制度能夠?qū)崿F(xiàn)最大限度保護(hù)未成年犯罪人利益和社會利益。
[Abstract]:The system of sealing and keeping criminal records should meet the requirements of helping juvenile delinquents to "de-label" and "re-socialize" and to maintain social stability and harmony. There are some problems such as improper leakage of criminal information, limited employment of minors, difficulties in integrating into the society, too rigid scope of closure and so on in the current system of keeping juvenile criminal records in our country. From the perspective of bidirectional protection concept, this paper conceives a reasonable path to perfect the system from the aspects of information protection, prohibition of employment, and the scope of sealing and storing, in order to maximize the protection of the interests of juvenile offenders and the interests of society in the system of sealing and storing criminal records.
