【摘要】:大規(guī)模的人口流動(dòng)是我國社會(huì)經(jīng)濟(jì)發(fā)展中出現(xiàn)的客觀現(xiàn)象,也是市場(chǎng)經(jīng)濟(jì)條件下勞動(dòng)力資源市場(chǎng)配置的必然結(jié)果,這一現(xiàn)象的出現(xiàn)與我國僵化的戶籍制度存在密切關(guān)聯(lián)。被標(biāo)簽化為“流動(dòng)人口”的社會(huì)群體由于各種原因,犯罪率相對(duì)較高,如何對(duì)流動(dòng)人口群體適用刑事強(qiáng)制措施,實(shí)現(xiàn)刑事訴訟程序保證和犯罪嫌疑人、被告人權(quán)利保護(hù)的平衡,是刑事訴訟法律實(shí)施過程中難以回避的問題。以取保候?qū)彏槔,流?dòng)人口涉罪人員適用取保候?qū)彽谋壤^低,這一現(xiàn)象的成因較為復(fù)雜,表面原因是流動(dòng)人口涉罪人員無法提供足夠的保證金或提出合格的能夠履行保證義務(wù)的保證人,但根本原因是我國《刑事訴訟法》還沒有確立起“保釋是常態(tài),羈押是例外”的原則,羈押性強(qiáng)制措施適用比例偏高,取保候?qū)徳趦?nèi)的非羈押性強(qiáng)制措施沒有得到足夠的重視。 通過實(shí)證研究、規(guī)范研究、比較研究等法學(xué)分析方法,本文分析了流動(dòng)人口取保候?qū)弻?shí)踐中存在的問題,分析其成因,并反思了現(xiàn)行的取保候?qū)徶贫,提出了相關(guān)完善意見。正文可以分為四個(gè)部分,每一部分的內(nèi)容如下:第一部分是前言,前言部分主要交代了研究背景、研究的主要對(duì)象與內(nèi)容、研究的主旨等,這是全文研究工作的起點(diǎn);第二部分是W市流動(dòng)人口取保候?qū)彽膶?shí)證調(diào)研成果。本部分主要通過實(shí)證研究的方法分析了整個(gè)W市在流動(dòng)人口取保候?qū)弻?shí)踐中的概況、實(shí)施機(jī)制以及所采用的創(chuàng)新辦法,通過對(duì)W市流動(dòng)人口取保候?qū)弻?shí)踐現(xiàn)狀來看,W市作為東部經(jīng)濟(jì)發(fā)達(dá)城市,面臨較為嚴(yán)峻的外來人口犯罪形勢(shì),流動(dòng)人口適用取保候?qū)彽谋壤,盡管該市采取了一些創(chuàng)新機(jī)制以促進(jìn)取保候?qū)徶贫鹊膶?shí)施,但是無法從根本上解決取保候?qū)徶贫葘?shí)施中的難題;第三部分是W市流動(dòng)人口適用取保候?qū)彺嬖诘膯栴}。本部分主要從現(xiàn)行法律制度出發(fā),從規(guī)范分析和比較分析的角度探討了我國當(dāng)前流動(dòng)人口取保候?qū)忂m用率偏低的成因,并將其歸結(jié)為理念層面和規(guī)范層面兩個(gè)方面的原因,認(rèn)為司法機(jī)關(guān)注重羈押性強(qiáng)制措施,忽視非羈押性強(qiáng)制措施,以及現(xiàn)有的取保候?qū)徶贫缺旧韺?duì)流動(dòng)人口的某些不適用性導(dǎo)致了流動(dòng)人口適用取保候?qū)徠偷默F(xiàn)象;第四部分是我國流動(dòng)人口取保候?qū)弻?shí)施機(jī)制的完善。本部分主要首先分析了流動(dòng)人口犯罪案件中適用取保候?qū)彂?yīng)秉持的基本理念,即應(yīng)以人權(quán)保障為理念指導(dǎo),以消除取保候?qū)忂m用障礙為基本目標(biāo)。在具體的措施上,則可以進(jìn)一步分為兩個(gè)層面:第一,現(xiàn)有制度的實(shí)施層面,應(yīng)細(xì)化取保候?qū)徶贫鹊倪m用規(guī)則,嚴(yán)禁司法機(jī)關(guān)提出超越現(xiàn)行法律規(guī)定的過高要求;第二,在現(xiàn)有制度的改革層面,建議立法明確非羈押性強(qiáng)制措施優(yōu)先適用的原則,并在取保候?qū)彽倪m用范圍上實(shí)現(xiàn)立法范式轉(zhuǎn)換,,從規(guī)定取保候?qū)彽恼孢m用范圍轉(zhuǎn)變?yōu)橐?guī)定取保候?qū)彽姆疵孢m用范圍,從而實(shí)現(xiàn)取保候?qū)忂m用范圍的拓展,以從根本上解決流動(dòng)人口涉罪人員適用取保候?qū)忞y題。
[Abstract]:The large-scale population flow is an objective phenomenon in the social and economic development of our country. It is also the inevitable result of the market allocation of labor resources under the market economy. The emergence of this phenomenon is closely related to the rigid household registration system in China. The social groups labeled "floating population" are relative to the crime rate for a variety of reasons. Higher, how to apply criminal coercive measures to the floating population, realize the guarantee of criminal procedure and the balance of the protection of the right of the accused and the defendant is an unavoidable problem in the implementation of the criminal procedure law. Taking the bail pending trial as an example, the proportion of the floating population involved in the bail pending trial is lower, the cause of the phenomenon More complicated, the reason is that the floating population is unable to provide sufficient margin or to put forward a qualified guarantor to fulfill the obligation, but the fundamental reason is that the principle of "the law of criminal procedure" has not established the principle of "bail is normal and the detention is an exception", and the proportion of the coercive measures in custody is high, and the bail pending trial is in the pending trial. The non custodial mandatory measures have not received enough attention.
Through empirical research, normative research, comparative study and other legal analysis methods, this paper analyzes the existing problems in the practice of floating population bail pending trial, analyzes its causes, and rethinks the current system of bail pending trial, and puts forward some relevant suggestions. The text can be divided into four parts, each part is as follows: the first part is preface, The preface mainly explains the research background, the main object and content of the research, the main purpose of the research, this is the starting point of the full text research work; the second part is the empirical research results of the W City floating population bail pending trial. This part mainly analyzes the general situation of the whole W city in the practice of the floating population bail pending trial through the empirical research method. The implementation mechanism and the innovative methods adopted, through the current situation of the bail pending trial practice of the floating population in W City, W City, as an economically developed city in the East, faces a more severe foreign population crime situation, and the proportion of the floating population to the bail pending trial is low. Although the city has adopted some innovative mechanisms to promote the system of bail pending trial, the city has taken some new mechanisms to promote the system of bail pending trial. But it can not solve the difficult problems in the implementation of the system of bail pending trial; the third part is the existing problems in the application of the bail pending trial of the floating population in the city of W. This part is mainly from the current legal system, and discusses the causes of the low application rate of the current mobile people's bail pending trial from the perspective of the normative analysis and comparative analysis. It is attributed to two aspects of the concept level and the standard level. It is considered that the judicial organs pay attention to the coercive measures of custody, ignore the non custodial coercive measures, and the existing inapplicability of the existing bail pending trial system itself to the floating population leads to the low application of the bail pending trial for the floating population; the fourth part is the floating people of our country. This part mainly analyzes the basic idea that the application of the bail pending trial in the floating population crime cases should be guided by the concept of human rights protection as the guiding principle and the basic goal of eliminating the barriers to application of the bail pending trial. In the concrete measures, it can be further divided into two levels: first, the existing The implementation level of the system should refine the applicable rules of the bail pending trial system and strictly prohibit the judicial organs to put forward the high requirements beyond the current legal provisions; second, in the reform level of the existing system, the principle of giving priority to the application of non custodial coercive measures is suggested, and the transformation of the legislative paradigm is realized in the scope of the application of the bail pending trial and the transformation of the legislative paradigm from the scope of the application of the bail pending trial.
