【摘要】：未成年人刑事司法具有較強的社會屬性,其有效運行有賴于發(fā)達的社會支持體系。我國未成年人刑事司法面臨的突出問題是社會參與程度低,司法機關與社會力量之間的信息共享及資源鏈接機制不健全、青少年司法社工力量不足以及政府資金支持缺位,導致社會支持難以體系化、規(guī)范化和常態(tài)化。厘清社會支持體系的內(nèi)涵、結構、主體范圍及其內(nèi)容,為未成年人刑事司法社會支持體系建設奠定理論基礎。通過建立信息共享及資源鏈接機制、實現(xiàn)未成年人刑事司法與社會工作相結合,以保障社會支持的有效性。通過制定社會參與規(guī)則、設立統(tǒng)籌社會支持體系建設的機構、探索多元化的資金支持途徑,以實現(xiàn)社會支持的可持續(xù)發(fā)展。
[Abstract]:Juvenile criminal justice has a strong social attribute, and its effective operation depends on developed social support system. The outstanding problems faced by juvenile criminal justice in China are the low degree of social participation, the imperfect mechanism of information sharing and resource linking between judicial organs and social forces, the shortage of juvenile justice social workers and the absence of government financial support. It is difficult to systematize, standardize and normalize social support. To clarify the connotation, structure, subject scope and content of the social support system, lay a theoretical foundation for the construction of the juvenile criminal justice social support system. Through establishing the mechanism of information sharing and resource linking, we can realize the combination of juvenile criminal justice and social work in order to ensure the effectiveness of social support. In order to realize the sustainable development of social support, the establishment of social participation rules, the establishment of the overall organization of social support system, and the exploration of diversified ways of funding support are carried out in order to realize the sustainable development of social support.
