本文選題：環(huán)境民事公益訴訟 + 檢察機(jī)關(guān)��； 參考：《內(nèi)蒙古大學(xué)》2017年碩士論文

【摘要】：最高人民檢察院與最高人民法院分別下發(fā)了公益訴訟試點(diǎn)工作方案,指導(dǎo)試點(diǎn)地區(qū)具體工作流程,并在其中賦予檢察機(jī)關(guān)一個新身份——"公益訴訟人"。但這僅僅是在政策方針角度為檢察機(jī)關(guān)提起環(huán)境民事公益訴訟制度做出一個鋪墊,從司法實(shí)踐運(yùn)行的情況來看仍有諸多問題值得考量。在環(huán)境民事公益訴訟領(lǐng)域,從具體案例與域外制度分析來看,由檢察機(jī)關(guān)來提起訴訟要比其他國家行政機(jī)關(guān)和社會環(huán)保組織更有優(yōu)勢,但是,在我國,檢察機(jī)關(guān)目前沒有被任何法律法規(guī)確定原告主體地位,其在環(huán)境民事公益訴訟中主要起支持、督促有關(guān)機(jī)關(guān)和社會組織提起訴訟的作用,很多現(xiàn)實(shí)因素導(dǎo)致其在司法實(shí)踐中陷入重重困境。從實(shí)際出發(fā),對其困境進(jìn)行分析可知,檢察機(jī)關(guān)提起環(huán)境民事公益訴訟制度若要發(fā)展不僅要在立法上進(jìn)行改革,賦予其訴權(quán),協(xié)調(diào)好與其他訴訟主體的關(guān)系,使其介入訴訟程序時(shí)更具有主動性,也要依賴檢察機(jī)關(guān)自身對形式公益與實(shí)質(zhì)公益的準(zhǔn)確區(qū)分,透徹理解環(huán)境民事公益訴訟的目的所在,這樣才可能脫離實(shí)踐困境。在保證訴訟程序公平公正的同時(shí),通過司法手段維護(hù)環(huán)境公共利益,提高環(huán)境污染救濟(jì)效率,助力人與自然和諧并進(jìn)的可持續(xù)發(fā)展戰(zhàn)略。
[Abstract]:The Supreme people's Procuratorate and the Supreme people's Court separately issued a pilot work plan for public interest litigation, guiding the specific work flow in the pilot area, and endowing the procuratorial organ with a new identity-"public interest litigant." However, this is only to lay the groundwork for the procuratorial organ to initiate the environmental civil public interest litigation system from the angle of policy and policy, and there are still many problems worth considering from the operation of judicial practice. In the field of environmental civil public interest litigation, from the analysis of specific cases and extraterritorial systems, the prosecution organs have more advantages than other administrative organs and social environmental protection organizations. However, in our country, At present, the procuratorial organ has not been determined by any laws and regulations as the main body of the plaintiff. It plays a major role in supporting the environmental civil public interest litigation and urging the relevant organs and social organizations to file a lawsuit. Many realistic factors lead to its difficulties in judicial practice. Proceeding from the reality, we can know that if the procuratorial organ wants to develop the system of environmental civil public interest litigation, it should not only reform its legislation, endow it with the right of action, but also coordinate its relationship with other litigant subjects. It is necessary to rely on the procuratorial organs to distinguish the formal public interest from the substantive public interest and to understand thoroughly the purpose of environmental civil public interest litigation. Only in this way can we break away from the practical dilemma. While ensuring the fairness and fairness of the litigation procedure, the sustainable development strategy of maintaining the public interests of the environment through judicial means, improving the efficiency of the relief of environmental pollution and promoting the harmonious development of man and nature is put forward.
