庭審實(shí)質(zhì)化的技術(shù)路徑反思與政治路徑證成

【摘要】:庭審實(shí)質(zhì)化改革目前呈現(xiàn)一幅技術(shù)主義改革圖景,取得了初步成效,也有值得反思之處。技術(shù)路徑無法應(yīng)對庭審實(shí)質(zhì)化改革存在的法院對公安、檢察機(jī)關(guān)的制度性制約能力不足這一積難問題。政治路徑與技術(shù)路徑互為補(bǔ)充、相互協(xié)作,是對技術(shù)路徑無法解決的法院制約能力不足等涉及司法體制的深層次問題作出的回應(yīng)和相應(yīng)的政治安排。政治路徑通過提高法院的政治地位和政治待遇等政治舉措來加強(qiáng)法院的司法制約能力,從而完成庭審實(shí)質(zhì)化的改革任務(wù)。根據(jù)實(shí)際情況,政治路徑在中央和地方層面可以有不同的方案。
[Abstract]:At present, the reform of trial materialization presents a picture of technocratic reform, which has achieved initial results and is worthy of reflection. The technical path is unable to cope with the shortage of institutional restriction ability of the court to the public security and the procuratorial organ, which exists in the reform of the essence of the trial. The political path and the technical path complement each other and cooperate with each other, which is the response and corresponding political arrangement to the deep problems related to the judicial system, such as the insufficiency of the court's restriction capacity, which cannot be solved by the technical path. The political path strengthens the judicial restriction ability of the court through political measures such as improving the political status and political treatment of the court, thus accomplishing the reform task of the court's materialization. Depending on the actual situation, the political path can have different programs at the central and local levels.
