【摘要】：1946年，世界第一臺(tái)計(jì)算機(jī)在美國(guó)賓夕法尼亞大學(xué)誕生，接下來(lái)的幾十年電子技術(shù)發(fā)展迅猛,身邊的電子產(chǎn)品無(wú)處不在。人們?cè)絹?lái)越感受到科技帶來(lái)的方便與快捷，電子活動(dòng)數(shù)量日益增加，以計(jì)算機(jī)及其網(wǎng)絡(luò)為依托的電子數(shù)據(jù)在證明案件事實(shí)的過(guò)程中起著越來(lái)越重要的作用，由此引發(fā)一些新的糾紛形式，作為一種新型的證據(jù)----電子數(shù)據(jù)證據(jù)。國(guó)外的部分國(guó)家對(duì)電子數(shù)據(jù)進(jìn)入訴訟有了相關(guān)的法律條文，有的國(guó)家已經(jīng)具備自己成套的電子數(shù)據(jù)證據(jù)規(guī)則體系。我國(guó)有關(guān)電子數(shù)據(jù)證據(jù)在民事領(lǐng)域的研究起步較晚，長(zhǎng)期以來(lái)我國(guó)電子數(shù)據(jù)證據(jù)遲遲未能被明確賦予合法的身份，直到最新修訂的《中華人民共和國(guó)民事訴訟法》將電子數(shù)據(jù)明確與書(shū)證、物證等列為證據(jù)種類(lèi)之一，但理論界對(duì)電子數(shù)據(jù)證據(jù)的定義不統(tǒng)一，，電子數(shù)據(jù)證據(jù)的法律定位以及在民事訴訟實(shí)務(wù)中的具體運(yùn)用等都存在著一定的分歧。本文致力研究電子數(shù)據(jù)證據(jù)的舉證規(guī)則，從電子數(shù)據(jù)的基本概念出發(fā)，合理的界定定義電子數(shù)據(jù)證據(jù)，進(jìn)一步研究電子數(shù)據(jù)證據(jù)的特殊性，從分析電子數(shù)據(jù)證據(jù)特殊性對(duì)電子數(shù)據(jù)舉證規(guī)則的影響，研究我國(guó)有關(guān)電子數(shù)據(jù)證據(jù)立法的現(xiàn)有規(guī)定，總結(jié)不足和缺陷，提出合理的舉證規(guī)則，對(duì)舉證倒置情況的分析探討，為民事訴訟證據(jù)體系的完善作出微薄貢獻(xiàn)。
[Abstract]:In 1946, the world's first computer was born in the University of Pennsylvania, the following decades of rapid development of electronic technology, around the electronic products everywhere. More and more people feel the convenience and rapidity brought by science and technology, and the number of electronic activities is increasing. Electronic data based on computers and their networks play an increasingly important role in the process of proving the facts of cases. As a new kind of evidence-electronic data evidence, some new forms of dispute are caused. Some foreign countries have some relevant legal provisions on electronic data entry litigation, and some countries already have their own complete set of electronic data evidence rules system. The research on electronic data evidence in our country started relatively late in the civil field. For a long time, the electronic data evidence in our country has not been clearly assigned a legal identity for a long time. Until the newly revised Civil procedure Law of the people's Republic of China listed electronic data as one of the categories of evidence, the definition of electronic data evidence was not uniform. There are some differences in the legal orientation of electronic data evidence and its application in civil litigation practice. This paper is devoted to studying the rule of proof of electronic data evidence, starting from the basic concept of electronic data, reasonably defining and defining electronic data evidence, and further studying the particularity of electronic data evidence. Based on the analysis of the influence of the particularity of electronic data evidence on the rule of proof of electronic data, this paper studies the existing provisions on the legislation of electronic data evidence in China, summarizes the shortcomings and defects, puts forward the reasonable rules of proof, and analyzes and probes into the situation of evidence inversion. To make a meager contribution to the perfection of the evidence system in civil litigation.
