【摘要】:隨著互聯(lián)網(wǎng)的普及,網(wǎng)絡(luò)交易市場(chǎng)日益繁榮。近年來(lái),受?chē)?guó)外Groupon團(tuán)購(gòu)模式的影響,我國(guó)網(wǎng)絡(luò)團(tuán)購(gòu)市場(chǎng)也迅速發(fā)展。憑借著網(wǎng)絡(luò)交易和團(tuán)購(gòu)這兩大新型購(gòu)物模式的優(yōu)勢(shì),網(wǎng)絡(luò)團(tuán)購(gòu)消費(fèi)者的議價(jià)能力得到了很大的提高,購(gòu)買(mǎi)了很多商品物美價(jià)廉,,切切實(shí)實(shí)的享受到了高科技帶給生活的便利。但是,在消費(fèi)者享受著這些好處的同時(shí),也帶來(lái)許多不好的后果。由于缺乏法律的有效規(guī)制、行業(yè)監(jiān)督和個(gè)人誠(chéng)信,導(dǎo)致了許多侵犯網(wǎng)絡(luò)團(tuán)購(gòu)消費(fèi)者權(quán)益的現(xiàn)象,嚴(yán)重阻礙了網(wǎng)絡(luò)團(tuán)購(gòu)行業(yè)的健康發(fā)展。有鑒于此,本文從保護(hù)消費(fèi)者權(quán)益的角度出發(fā),在充分分析了我國(guó)網(wǎng)絡(luò)團(tuán)購(gòu)行業(yè)發(fā)展現(xiàn)狀、網(wǎng)絡(luò)團(tuán)購(gòu)給消費(fèi)者權(quán)益帶來(lái)的挑戰(zhàn)和立法對(duì)消費(fèi)者權(quán)益保護(hù)現(xiàn)狀的基礎(chǔ)上,提出了完善我國(guó)網(wǎng)絡(luò)團(tuán)購(gòu)消費(fèi)者權(quán)益保護(hù)建議。 除引言和致謝外,本文共分為四個(gè)部分進(jìn)行論述。 第一部分為“網(wǎng)絡(luò)團(tuán)購(gòu)概述”,首先闡述了網(wǎng)絡(luò)團(tuán)購(gòu)的概念,其次介紹了網(wǎng)絡(luò)團(tuán)購(gòu)的模式,分析各種網(wǎng)絡(luò)團(tuán)購(gòu)模式與普通網(wǎng)絡(luò)購(gòu)物模式的區(qū)別并最終確定本文主要研究第三方發(fā)起模式,進(jìn)而研究該模式的特點(diǎn),最后概括了我國(guó)網(wǎng)絡(luò)團(tuán)購(gòu)行業(yè)的發(fā)展現(xiàn)狀。 第二部分是“網(wǎng)絡(luò)團(tuán)購(gòu)給我國(guó)消費(fèi)者權(quán)益保護(hù)帶來(lái)的挑戰(zhàn)”,也是本文的重點(diǎn),以消費(fèi)者權(quán)利為基礎(chǔ),結(jié)合廣大網(wǎng)絡(luò)團(tuán)購(gòu)消費(fèi)者購(gòu)物的實(shí)際,分析了網(wǎng)絡(luò)團(tuán)購(gòu)給消費(fèi)者安全權(quán)、知情權(quán)、公平交易權(quán)和求償權(quán)帶來(lái)的挑戰(zhàn)。 第三部分是“我國(guó)網(wǎng)絡(luò)團(tuán)購(gòu)消費(fèi)者權(quán)益的法律保護(hù)”,闡述了我國(guó)網(wǎng)絡(luò)團(tuán)購(gòu)消費(fèi)者權(quán)益的立法、司法保護(hù)的基本情況,重點(diǎn)分析了目前我國(guó)網(wǎng)絡(luò)團(tuán)購(gòu)消費(fèi)者權(quán)益法律保護(hù)的不足。 第四部分是“我國(guó)網(wǎng)絡(luò)團(tuán)購(gòu)消費(fèi)者權(quán)益保護(hù)的完善”,是本文的重點(diǎn)和難點(diǎn),主要是針對(duì)本文的第二部分和第三部分中所論述的我國(guó)網(wǎng)絡(luò)團(tuán)購(gòu)消費(fèi)者權(quán)益面臨的挑戰(zhàn)和法律保護(hù)的不足提出的完善措施。
[Abstract]:With the popularity of the Internet, the network trading market is booming. In recent years, under the influence of foreign Groupon group purchase mode, our country network group purchase market also develops rapidly. Relying on the advantages of the two new shopping modes of online trading and group buying, the bargaining power of online group buying consumers has been greatly improved, and a lot of goods have been purchased at a good price and cheap, and they have enjoyed the convenience brought by high technology to life. However, while consumers enjoy these benefits, there are also many negative consequences. Due to the lack of effective legal regulation, industry supervision and personal integrity, it leads to a lot of violations of the rights and interests of online group buying consumers, and seriously hinders the healthy development of the online group buying industry. In view of this, from the angle of protecting the rights and interests of consumers, this paper analyzes the current situation of the development of the online group buying industry, the challenges brought by the network group buying to the consumers' rights and interests, and the current situation of the protection of the consumers' rights and interests by legislation. Some suggestions are put forward to improve the protection of consumers' rights and interests. In addition to the introduction and thanks, this article is divided into four parts to discuss. The first part is "the network group purchase outline", first elaborated the network group purchase concept, then introduced the network group purchase pattern, This paper analyzes the differences between various online group buying models and ordinary online shopping models, and finally determines that this paper mainly studies the third-party initiation model, and then studies the characteristics of this model. Finally, it summarizes the development status of China's network group buying industry. The second part is "the challenge to the protection of consumers' rights and interests brought by online group buying", which is also the focus of this paper. Based on the rights of consumers, the paper analyzes the right of online group buying to consumers' safety, combined with the reality of the vast number of online group buying consumers' shopping. The right to know, the right to fair trade and the right to claim. The third part is "the legal protection of the rights and interests of the online group buying consumers in China", which expounds the basic situation of the legislation and judicial protection of the rights and interests of the online group buying consumers in our country. Focus on the analysis of the current network group purchase consumer rights and interests of the legal protection deficiencies. The fourth part is the perfection of the protection of consumers' rights and interests in China's network group buying, which is the focus and difficulty of this paper. This article mainly aims at the second part and the third part of this article discusses the network group purchase consumer rights and interests in our country to face the challenge and the legal protection insufficiency proposed the consummation measure.
