【摘要】：正政法委要在新的形勢(shì)下重新定位自己的職能。政法委要把依法執(zhí)政作為根本指導(dǎo)思想,把維護(hù)憲法法律的最高權(quán)威作為基本職能。首先,要維護(hù)司法獨(dú)立,實(shí)行黨法分開,地方政法委書記不能兼任公檢法機(jī)關(guān)的領(lǐng)導(dǎo)職務(wù)。政法委對(duì)司法個(gè)案應(yīng)該堅(jiān)持不協(xié)調(diào)、不批示、不提處理意見,禁止地方黨委干預(yù)個(gè)案,對(duì)干預(yù)司法個(gè)案的領(lǐng)導(dǎo)干部要給予紀(jì)律追究。其次,將政法委的職能定位于深化司法體制改革,完善司法制度,把制度建
[Abstract]:The political and legal Commission should reposition its functions in the new situation. The political and legal Commission should take the ruling by law as the fundamental guiding ideology and the maintenance of the supreme authority of the constitutional law as its basic function. First of all, it is necessary to safeguard the independence of the judiciary and implement the separation of the party and law, and the secretaries of the local political and legal committees cannot concurrently hold leading posts in the public security bureaus, procuratorates, and court organs. The political and legal Commission should persist in not coordinating judicial cases, do not give instructions, do not raise opinions on handling them, prohibit local party committees from interfering in cases, and give disciplinary action to leading cadres who interfere in judicial cases. Secondly, we should position the functions of the political and legal Commission to deepen the reform of the judicial system, improve the judicial system, and build the system.
