【摘要】：正2014年,法國創(chuàng)設(shè)性地引入了由司法警官主導(dǎo)的刑事交易制度,引發(fā)了諸多關(guān)注和質(zhì)疑。刑事交易制度授權(quán)司法警官在公訴啟動前就公訴事項與涉案自然人及法人進(jìn)行交易,是訴訟效率最大化的設(shè)計,但也最容易損及程序正義及相關(guān)當(dāng)事人的權(quán)利。
[Abstract]:In 2014, France introduced a criminal trading system dominated by judicial police officers, which aroused a lot of concern and doubt. The criminal transaction system empowers the judicial police officers to deal with the natural and legal persons involved in the public prosecution before the commencement of the public prosecution, which is the design of maximizing the efficiency of the litigation, but it is also the most vulnerable to the procedural justice and the rights of the relevant parties.
