【摘要】：指供是極易導(dǎo)致冤假錯(cuò)案的一種取證方法,在實(shí)踐中大多與刑訊逼供、威脅、引誘等方法合并使用。指供使虛假口供與其它證據(jù)形成印證,因而使虛假口供難以被識(shí)別和剔除,同時(shí)也導(dǎo)致非法口供更難被排除,所以指供有造成冤假錯(cuò)案的高度危險(xiǎn)性。對(duì)于指供所獲口供,應(yīng)設(shè)置單獨(dú)的口供排除規(guī)則,而不能依附于刑訊逼供等非法方法所獲口供的排除。是否可能使無(wú)辜嫌疑人承認(rèn)自己有罪并按照審訊人員意圖而作出犯罪事實(shí)細(xì)節(jié)的虛假口供,是指供所獲口供的判斷標(biāo)準(zhǔn)。具體而言,應(yīng)當(dāng)從審訊人員是否透露不應(yīng)透露的證據(jù)或信息、嫌疑人是否會(huì)受審訊人員指供內(nèi)容影響而虛假供述兩個(gè)方面進(jìn)行判斷。但在一些例外情形下指供所獲口供無(wú)須排除,如對(duì)嫌疑人口供進(jìn)行了其它途徑的驗(yàn)證,或指供內(nèi)容不會(huì)導(dǎo)致錯(cuò)誤認(rèn)定事實(shí)。
[Abstract]:Referring to confession is a method of obtaining evidence which can easily lead to false and false cases. In practice, it is mostly used in combination with methods of extorting confessions by torture, threats, inducements and so on. It is difficult to identify and eliminate false confessions, and at the same time, it is more difficult to exclude illegal confessions. For confessions obtained by torture, separate rules should be set up to exclude confessions obtained by illegal means, such as extorting confessions by torture, instead of relying on the exclusion of confessions obtained by illegal means such as extortion of confessions by torture. Whether it is possible for innocent suspects to admit their guilt and make false confessions according to the intention of the interrogators to make the details of the facts of the crime refers to the judgment standard of the confessions obtained. Specifically, it should be judged from two aspects: whether the interrogator should disclose the evidence or information that should not be disclosed, and whether the suspect will be affected by the interrogator's false confession. However, in some exceptional cases, it is not necessary to exclude the confession obtained by the evidence, for example, the confession of the suspect is verified by other means, or the content of the confession does not lead to a false determination of the fact.
