【摘要】：刑事訴訟法正式實施已半年有余,作為刑訴法新增內(nèi)容之一的偵查人員出庭說明情況,在實踐中適用的整體數(shù)量偏低、效果不佳,凸顯出偵查人員出庭動力不足、偵查資源相對匱乏、偵查人員出庭技巧不足等問題。對此,應(yīng)提升偵查人員的規(guī)范執(zhí)法水平、提高偵查人員的出庭技巧,完善公檢法機(jī)關(guān)之間的出庭協(xié)調(diào)機(jī)制,并細(xì)化出庭說明情況的程序性后果、原則、范圍、形式。
[Abstract]:It has been more than half a year since the formal implementation of the Criminal procedure Law. As one of the new contents of the Criminal procedure Law, the investigators appear in court to explain the situation. The overall number of the investigators applied in practice is on the low side and the effect is not good, which highlights the lack of motivation for the investigators to appear in court.The investigation resources are relatively scarce and the investigators' techniques of appearing in court are insufficient.In view of this, we should improve the standard law enforcement level of the investigators, improve the skills of the investigators to appear in court, perfect the coordination mechanism between the public security bureau, the procuratorate and the court organs, and refine the procedural consequences, principles, scope and forms of the explanation of the appearance in court.
