【摘要】：在犯罪行為逐步科技化,偵破案件難度增加的情況下,技術(shù)偵查應運而生,但是由于技術(shù)偵查不同于傳統(tǒng)偵查方式,其技術(shù)性、隱蔽性和易侵權(quán)性的特點使得其在一定程度上會侵害到公民的隱私權(quán)。雖然新《刑事訴訟法》對技術(shù)偵查進行了相應的規(guī)制,但是由于立法的原則化,對其程序規(guī)制仍然很籠統(tǒng),容易侵犯偵查相對人的隱私權(quán)。本文具體分析技術(shù)偵查中隱私權(quán)保護存在的問題,從技術(shù)偵查適用范圍、適用條件,技術(shù)偵查的監(jiān)督機制,獲取證據(jù)保存使用以及對隱私權(quán)法律保護等方面展開討論,為我國技術(shù)偵查偵查中隱私權(quán)的保護帶來有益構(gòu)想。為更深入的研究技術(shù)偵查中隱私權(quán)的保護問題,本文通過對美國監(jiān)聽制度,德國監(jiān)聽制度,英國的技術(shù)偵查制度中隱私權(quán)保護措施的分析與比較,對域外技術(shù)偵查中隱私權(quán)保護的相關(guān)特點以及先進經(jīng)驗進行探討。本文最后針對我國技術(shù)偵查的適用規(guī)范、審批程序、證據(jù)規(guī)定、隱私權(quán)立法保護以及權(quán)利保障等方面存在的問題提出了完善建議,以期技術(shù)偵查制度走向規(guī)范化、法治化。
[Abstract]:Under the circumstances that the crime is becoming more and more scientific and difficult, the technical investigation emerges as the times require. However, because the technical investigation is different from the traditional investigation, it is technical.The characteristics of concealment and easily infringing make it encroach on citizen's right of privacy to a certain extent.Although the new Code of Criminal procedure regulates the technical investigation according to the principle of legislation, the procedural regulation is still very general, and it is easy to infringe the privacy of the relative party of investigation.This paper specifically analyzes the problems existing in the protection of the right to privacy in the technical investigation, and discusses the scope of application, the applicable conditions, the supervisory mechanism of the technical investigation, the preservation and use of the evidence obtained, and the legal protection of the right to privacy, etc.It is beneficial to the protection of the right of privacy in the technical investigation of our country.In order to further study the protection of privacy in technical investigation, this paper analyzes and compares the privacy protection measures of the American surveillance system, the German surveillance system and the British technical investigation system.This paper discusses the relevant characteristics and advanced experience of privacy protection in overseas technical investigation.At the end of this paper, the author puts forward some suggestions on the application of technical investigation in China, examination and approval procedure, evidence regulation, legislative protection of privacy and protection of right, in order to standardize and rule by law the system of technical investigation.
