【摘要】：為了保護(hù)涉罪未成年人，我國(guó)于2013年《刑事訴訟法》修正案中的未成年人特殊程序第271條設(shè)定了未成年人附條件不起訴制度。附條件不起訴制度的建立是我國(guó)未成年人刑事立法及司法實(shí)踐的重大突破，，有利于實(shí)現(xiàn)對(duì)未成年人的特殊優(yōu)先保護(hù)。但刑事訴訟法關(guān)于未成年人附條件不起訴的規(guī)定仍然存在進(jìn)一步完善的空間，需要從規(guī)范相關(guān)程序、設(shè)定附加義務(wù)、完善制約機(jī)制等諸多方面進(jìn)行細(xì)化。本文中,筆者將對(duì)我國(guó)附條件不起訴制度的起源進(jìn)行回顧，說(shuō)明新《刑事訴訟法》設(shè)立附條件不起訴制度的立法價(jià)值所在。通過(guò)對(duì)附條件不起訴制度特征的分析，確立其不同于絕對(duì)不起訴、相對(duì)不起訴、刑事和解等制度的法律意義。通過(guò)對(duì)域外國(guó)家或地區(qū)的附條件不起訴制度的介紹，結(jié)合我國(guó)的自身特點(diǎn)進(jìn)行比較。我國(guó)附條件不起訴制度立法實(shí)施以來(lái)，在法律適用的過(guò)程中存在諸多問(wèn)題，本文對(duì)現(xiàn)狀進(jìn)行概括整理后，就附條件不起訴的啟動(dòng)、聽證等程序方面的設(shè)立標(biāo)準(zhǔn)提出建議；對(duì)附條件不起訴制度考察期間的考察及幫教制度進(jìn)行研究；探索附條件不起訴的制約機(jī)制和救濟(jì)途徑問(wèn)題，對(duì)構(gòu)建符合實(shí)踐的附條件不起訴制度提出自己的看法和建議。
[Abstract]:In order to protect the minors involved in crimes, article 271 of the special procedure for minors in the amendment of the Criminal procedure Law of China in 2013 established the system of non-prosecution of minors with conditions.The establishment of conditional non-prosecution system is a major breakthrough in the criminal legislation and judicial practice of minors in China, which is conducive to the realization of special priority protection for minors.However, there is still room for further improvement in the provisions of the Criminal procedure Law on minors attaching conditions and non-prosecution, which need to be refined from many aspects, such as standardizing the relevant procedures, setting additional obligations, perfecting the restriction mechanism, and so on.In this paper, the author will review the origin of the conditional non-prosecution system in China, and explain the legislative value of the establishment of the conditional non-prosecution system in the New Criminal procedure Law.By analyzing the characteristics of conditional non-prosecution system, the legal significance of the system is established, which is different from absolute non-prosecution, relative non-prosecution, criminal reconciliation and so on.This paper introduces the system of conditional non-prosecution in foreign countries and regions, and compares the characteristics of our country.There are many problems in the process of application of the law since the implementation of the conditional non-prosecution system in our country. After summarizing the present situation, this paper puts forward some suggestions on the establishment standards of the procedure such as the initiation of conditional non-prosecution and the hearing.This paper studies the investigation of conditional non-prosecution system and the system of help and education, explores the restriction mechanism and relief ways of conditional non-prosecution, and puts forward its own views and suggestions on the construction of conditional non-prosecution system in line with practice.
