【摘要】：現(xiàn)代社會已經(jīng)進入知識經(jīng)濟時代，現(xiàn)代科學技術已經(jīng)涉入到社會生活的各個方面，各種社會糾紛也不可避免的、越來越多的涉及到有關科學技術的專門性問題。因此，在現(xiàn)代訴訟中，鑒定意見在發(fā)現(xiàn)案件事實方面發(fā)揮著越來越重要的作用。與其他種類的證據(jù)相比較，鑒定意見更具有科學性、專業(yè)性，其被采信的可能性更高。但是，在我國，司法鑒定制度并不健全，鑒定程序啟動不合理、鑒定過程不規(guī)范、鑒定意見缺乏充分有效質(zhì)證等諸多因素導致鑒定意見的可靠性較低，頻頻受到當事人及社會的質(zhì)疑。雖然陸續(xù)出臺的各種法律法規(guī)不斷對我國司法鑒定制度進行改進，新通過的刑訴和民訴修正案也都對我國的司法鑒定制度進行了一定程度的完善，但是，許多問題依舊沒有解決，要想提高鑒定意見的可靠性還需要多個方面的進一步改進。本文分四部分，第一部分主要介紹本文的寫作背景、研究意義、國內(nèi)外研究現(xiàn)狀以及作者的研究計劃；第二部分對鑒定意見的可靠性進行概念的闡述；第三部分具體闡述我國鑒定意見可靠性低的表現(xiàn)并從鑒定意見的形成過程和質(zhì)證過程兩方面進一步分析鑒定意見可靠性較低的原因；最后一部分針對第三部分分析的原因提出一定的解決措施，從形成和質(zhì)證兩方面對鑒定意見加以完善，以期對鑒定意見可靠性的提高有所裨益。
[Abstract]:Modern society has entered the era of knowledge economy, modern science and technology has been involved in all aspects of social life, various social disputes are inevitable, more and more related to the specialized issues of science and technology.Therefore, in the modern litigation, the appraisal opinion plays a more and more important role in finding the facts of the case.Compared with other kinds of evidence, the appraisal opinion is more scientific and professional, and it is more likely to be accepted.However, in our country, the system of judicial identification is not perfect, the procedure of identification is not reasonable, the process of identification is not standardized, and the appraisal opinion is lack of sufficient and effective cross-examination, and so on, which leads to the low reliability of the appraisal opinion.Frequently questioned by the parties and society.Although various laws and regulations have been introduced one after another to continuously improve the judicial expertise system in China, the newly adopted amendments to criminal and civilian proceedings have also improved the judicial expertise system in China to a certain extent, but,Many problems remain unresolved, and further improvements are needed to improve the reliability of the opinion.This paper is divided into four parts. The first part mainly introduces the writing background, research significance, research status at home and abroad and the author's research plan, the second part describes the concept of reliability of appraisal opinion.The third part elaborates the performance of the low reliability of the appraisal opinion in China and further analyzes the reasons of the low reliability of the appraisal opinion from two aspects: the forming process of the appraisal opinion and the process of cross-examination.In the last part, the author puts forward some measures to solve the reasons of the third part, and perfect the appraisal opinions from the aspects of formation and cross-examination, in order to improve the reliability of the appraisal opinions.
