【摘要】:伴隨著現(xiàn)代社會(huì)經(jīng)濟(jì)與科學(xué)技術(shù)的迅速發(fā)展,政府管理社會(huì)生活的職責(zé)與權(quán)限在持續(xù)不停地?cái)U(kuò)大,行政機(jī)關(guān)也愈發(fā)地?fù)碛懈嗟男姓杂刹昧繖?quán)。在當(dāng)代政府管理社會(huì)生活的職責(zé)與權(quán)限中行政自由裁量權(quán)是必不可少的,我們所關(guān)注的焦點(diǎn)問題就是怎樣才能有效發(fā)揮行政自由裁量權(quán)積極的一方面,同時(shí)又可以避免或者盡全力最大限度地控制其消極的一方面,F(xiàn)代行政法學(xué)研究的重點(diǎn)問題之一就是行政自由裁量權(quán),作為行政機(jī)關(guān)的重要組成部分,公安機(jī)關(guān)及其人民警察是人民利益的捍衛(wèi)者和國(guó)家意志的實(shí)施者,其重要職能就是維護(hù)社會(huì)穩(wěn)定和保護(hù)公民的合法權(quán)利。行政自由裁量權(quán)一個(gè)非常重要的組成部分就是公安機(jī)關(guān)及其人民警察在執(zhí)法工作過程中的公安機(jī)關(guān)行政自由裁量權(quán),其屬于一種行政自由裁量權(quán)。公安機(jī)關(guān)承擔(dān)著行政執(zhí)法工作和司法工作的雙重職責(zé),是我們國(guó)家執(zhí)法機(jī)關(guān)的一個(gè)重要組成部分,行使公安機(jī)關(guān)行政自由裁量權(quán)在公安執(zhí)法工作過程中是非常有必要的。為了防止在執(zhí)法工作過程中公安機(jī)關(guān)及其人民民警對(duì)公安機(jī)關(guān)行政自由裁量權(quán)的濫用,目前我國(guó)公安機(jī)關(guān)正在嘗試著制定一些行政自由裁量的標(biāo)準(zhǔn),以達(dá)到從事前和事中兩個(gè)階段來控制濫用公安機(jī)關(guān)行政自由裁量權(quán)的目的。在制度建設(shè)方面,雖然目前我們對(duì)公安機(jī)關(guān)行政自由裁量權(quán)可以通過行政復(fù)議或行政訴訟來進(jìn)行一定程度的法律控制,但是對(duì)于濫用公安機(jī)關(guān)行政自由裁量權(quán)對(duì)公安機(jī)關(guān)行政相對(duì)人所造成的損害,盡管這種事后控制可以發(fā)揮一定的救濟(jì)效果,可是預(yù)防不了公安機(jī)關(guān)對(duì)公安機(jī)關(guān)行政自由裁量權(quán)的隨意濫用。由于公安機(jī)關(guān)行政自由裁量權(quán)具有較大的選擇權(quán)限,所以在執(zhí)法工作過程中十分容易被隨意濫用,從而導(dǎo)致了公安機(jī)關(guān)行政相對(duì)人對(duì)公安機(jī)關(guān)的依法行政產(chǎn)生了嚴(yán)重地質(zhì)疑。時(shí)下公安機(jī)關(guān)執(zhí)法工作過程中迫切急需解決的一個(gè)首要問題就是研究、分析和規(guī)制公安機(jī)關(guān)行政自由裁量權(quán),這樣既可以使其充分發(fā)揮積極作用,又可以最低限度地控制其消極作用。本人通過深入分析公安機(jī)關(guān)行政自由裁量權(quán)運(yùn)行中存在的問題及原因,把行政自由裁量權(quán)中的普遍原理與公安機(jī)關(guān)行政執(zhí)法工作過程中的實(shí)際狀況密切結(jié)合起來,為深刻理解和運(yùn)行公安機(jī)關(guān)行政自由裁量權(quán)提出一些建議。本文共分四個(gè)部分: 第一部分分別闡述了公安機(jī)關(guān)行政自由裁量權(quán)的概念、分類及特征。 第二部分客觀地分析了公安機(jī)關(guān)行政自由裁量權(quán)存在及對(duì)其進(jìn)行控制的必要性。 第三部分分析了公安機(jī)關(guān)行政自由裁量權(quán)在運(yùn)用中所存在的問題及對(duì)所存在的問題進(jìn)行了原因分析。 第四部分結(jié)合公安機(jī)關(guān)行政自由裁量權(quán)所存在的不足之處,針對(duì)性地提出了以立法、行政、司法和社會(huì)控制為切入點(diǎn),闡述控制和規(guī)范公安機(jī)關(guān)行政自由裁量權(quán)的途徑。
[Abstract]:With the rapid development of modern social economy and science and technology, the responsibility and authority of the government to manage the social life has been continuously expanded, and the administrative organs have more and more administrative discretion.The administrative discretion is essential in the responsibility and authority of the contemporary government to manage social life. The focus of our concern is how to give full play to the positive aspect of the administrative discretion.At the same time can avoid or try their best to control its negative aspects.One of the key issues in the study of modern administrative law is the administrative discretion. As an important part of the administrative organs, the public security organs and their people's police are the defenders of the interests of the people and the executors of the national will.Its important function is to maintain social stability and protect the legitimate rights of citizens.A very important component of the administrative discretion is the administrative discretion of the public security organs and the people's police in the process of law enforcement, which belongs to the administrative discretion.The public security organ bears the dual responsibility of the administrative law enforcement work and the judicial work, and is an important part of our national law enforcement organ. It is very necessary to exercise the administrative discretion power of the public security organ in the process of the public security law enforcement work.In order to prevent the abuse of the administrative discretion of public security organs by public security organs and their people's police in the course of law enforcement, at present, our public security organs are trying to formulate some standards for administrative discretion.In order to control the abuse of the administrative discretion of public security organs.In terms of system construction, although at present we can exercise a certain degree of legal control over the administrative discretion of public security organs through administrative reconsideration or administrative litigation.But with regard to the damage caused by abuse of the administrative discretion of the public security organ to the administrative counterpart of the public security organ, although this kind of post-incident control can play a certain relief effect,However, it cannot prevent the public security organs from abusing the administrative discretion of the public security organs.Because the administrative discretion of the public security organ has a great choice power, it is easy to be abused at will in the process of law enforcement, which leads to the public security organ administrative counterpart seriously questioning the administration of the public security organ according to the law.One of the most urgent problems in the process of law enforcement by public security organs is to study, analyze and regulate the administrative discretion of public security organs, so that they can play a positive role.They can also be minimally controlled for their negative effects.By deeply analyzing the problems and reasons existing in the operation of the administrative discretion of the public security organs, I closely combine the general principle of the administrative discretion with the actual situation in the process of the administrative law enforcement of the public security organs.Some suggestions are put forward for the deep understanding and operation of the administrative discretion of public security organs.This paper is divided into four parts:The first part expounds the concept, classification and characteristics of the administrative discretion of public security organs.The second part analyzes objectively the existence of administrative discretion of public security organs and the necessity of controlling it.The third part analyzes the problems existing in the application of the administrative discretion of public security organs and the reasons for the problems.The fourth part combines the shortcomings of the administrative discretion of the public security organs, and puts forward the ways to control and standardize the administrative discretion of the public security organs by taking the legislative, administrative, judicial and social control as the starting point.
