【摘要】：檢察垂直領(lǐng)導(dǎo)理論是列寧檢察權(quán)思想的精髓和重要組成部分,不僅構(gòu)筑為蘇俄和前蘇聯(lián)時(shí)期乃至于當(dāng)代俄羅斯檢察制度的理論基點(diǎn),而且對(duì)新中國(guó)成立初期檢察制度的建立和檢察體制的形成產(chǎn)生了重大影響。我國(guó)檢察系統(tǒng)曾經(jīng)兩度實(shí)行垂直領(lǐng)導(dǎo)體制,但是中國(guó)檢察制度借鑒列寧檢察垂直領(lǐng)導(dǎo)理論的歷史實(shí)踐并不順暢,最終演化為目前的雙重領(lǐng)導(dǎo)體制。在當(dāng)下中國(guó)司法改革的宏觀背景下,如何推進(jìn)檢察領(lǐng)導(dǎo)體制的改革是一項(xiàng)重大法治課題。重溫列寧檢察垂直領(lǐng)導(dǎo)思想及其理論邏輯,對(duì)于中國(guó)檢察體制改革的進(jìn)一步發(fā)展和完善,具有重要的理論借鑒價(jià)值和實(shí)踐指導(dǎo)意義。
[Abstract]:The theory of procuratorial vertical leadership is the essence and important component of Lenin's procuratorial power, which is not only the theoretical basis of Soviet Russia and the former Soviet Union, but also the contemporary Russian procuratorial system.Moreover, it has a great influence on the establishment of procuratorial system and the formation of procuratorial system in the early stage of the founding of New China.China's procuratorial system has twice implemented the vertical leadership system, but the historical practice of Chinese procuratorial system drawing lessons from Lenin's theory of vertical leadership is not smooth, and eventually evolved into the current dual leadership system.Under the macro background of judicial reform in China, how to promote the reform of procuratorial leadership system is an important subject of rule of law.Reviewing Lenin's thought of vertical procuratorial leadership and its theoretical logic has important theoretical reference value and practical guiding significance for the further development and improvement of China's procuratorial system reform.
