【摘要】：公證是公證機(jī)構(gòu)根據(jù)自然人、法人或者其他組織的申請,依照法定程序?qū)γ袷路尚袨�、有法律意義的事實和文書的真實性、合法性予以證明的活動。在預(yù)先防范糾紛以及解決社會矛盾方面,公證起到了重要作用,它憑借其所具備的特殊證明作用,間接促進(jìn)社會的發(fā)展以及經(jīng)濟(jì)的進(jìn)步。在整個公證活動中,公證審查是中心環(huán)節(jié),是保證公證有效性的最基本、最重要的程序,它關(guān)系到公證機(jī)構(gòu)能否依照當(dāng)事人的申請作出出具公證文書的決定。公證活動就是圍繞著公證審查這一核心而展開的。本文全文共分為四章,對我國公證審查制度進(jìn)行了論述。第一章介紹了公證審查制度。注重對公證制度和公證審查制度進(jìn)行了具體論述,對公證制度發(fā)展歷程進(jìn)行了梳理,對比兩大法系現(xiàn)行公證審查制度的異同,基于此最后介紹我國現(xiàn)行公證審查制度。第二章闡述了公證審查原則。主要介紹了公證審查制度的三個基本原則:真實合法性原則、目的性審查原則和直接原則。詳細(xì)闡釋三個基本原則概念內(nèi)涵,公證實踐中應(yīng)注意的事項以及如何貫穿基本原則。第三章分析了公證審查方式。重點(diǎn)介紹了形式審查和實質(zhì)審查兩種基本審查方式,對兩種審查方式進(jìn)行了比較分析,進(jìn)而引出我國確立公證審查方式的意義,以及理論界存在的爭議觀點(diǎn),提出我國確定公證審查方式的構(gòu)想,即"全面審查"方式。第四章梳理了公證審查范圍。分別從公證實體審查、公證程序?qū)彶閮蓚�大的方面進(jìn)行了詳細(xì)的分析,并對公證與認(rèn)證的審查范圍分別進(jìn)行了闡述。筆者建議將公證審查范圍進(jìn)行擴(kuò)大解釋,包含公證受理前的審查。
[Abstract]:Notarization is the activity of the notarization agency to prove the authenticity and legality of the civil legal act, the fact and the document of legal significance according to the application of natural person, legal person or other organization according to the legal procedure.Notarization plays an important role in preventing disputes and resolving social contradictions in advance. It indirectly promotes the development of society and the progress of economy by virtue of its special proof function.In the whole notarization activity, notarization is the central link and the most basic and important procedure to guarantee the validity of notarization. It relates to whether the notarization organization can make the decision of issuing notarization documents according to the application of the parties.Notarization is around the core of notarization.This paper is divided into four chapters, the notarization system of our country is discussed.The first chapter introduces the notarization system.Focusing on the notarization system and the notarization review system, this paper discusses the development of the notarization system, compares the similarities and differences of the existing notarization review system between the two major legal systems, and finally introduces the current notarization review system in China.The second chapter expounds the principle of notarization.This paper mainly introduces three basic principles of notarization system: the principle of true legality, the principle of purposeful examination and the principle of directness.This paper expounds the connotation of the three basic principles, the matters that should be paid attention to in notarization practice and how to run through the basic principles.Chapter three analyzes the way of notarization examination.This paper mainly introduces two kinds of basic examination methods: formal review and substantive review, and makes a comparative analysis of the two kinds of examination methods, and then leads to the significance of establishing the notarization review method in China, and the controversial viewpoints existing in the theoretical circle.This paper puts forward the idea of determining the way of notarization examination in our country, that is, "comprehensive review".The fourth chapter combs the scope of notarization review.Respectively from the notarization entity review, the notarization procedure review two big aspects have carried on the detailed analysis, and has carried on the elaboration to the notarization and the authentication examination scope separately.The author suggests that the scope of notarization should be expanded to include the review before notarization.
