行政調(diào)解制度的法理分析

【摘要】:當(dāng)前,我國(guó)處于經(jīng)濟(jì)高速發(fā)展、社會(huì)轉(zhuǎn)型的關(guān)鍵時(shí)期,利益主體多元化,各種矛盾激化,合理高效地解決這些糾紛,維護(hù)社會(huì)秩序的穩(wěn)定,構(gòu)建具有中國(guó)特色的社會(huì)主義和諧社會(huì)成為全國(guó)人民的共同目標(biāo)。行政調(diào)解制度在當(dāng)前的經(jīng)濟(jì)和社會(huì)生活中,越來(lái)越成為行政主體解決矛盾糾紛的重要手段之一。從理論方面而言,現(xiàn)代行政法平衡理論、行政合法性和正當(dāng)性理論、契約化理論都為行政調(diào)解作作為解決矛盾糾紛的重要手段提供了強(qiáng)大的理論依據(jù)。從實(shí)踐方面來(lái)看,作為一種準(zhǔn)司法性質(zhì)的制度,行政調(diào)解能夠提高行政效能,體現(xiàn)善治思想,節(jié)約司法資源,維護(hù)當(dāng)事人權(quán)益,提高公民權(quán)利意識(shí),維護(hù)公民尊嚴(yán),更將有助于構(gòu)建和完善我國(guó)多元化的糾紛解決制度。 目前我國(guó)行政調(diào)解制度存在行政調(diào)解協(xié)議性質(zhì)定位模糊,欠缺法律效力、行政調(diào)解主體地位不平等,相對(duì)人缺乏救濟(jì)途徑以及行政調(diào)解組織結(jié)構(gòu)不合理,調(diào)解人員素質(zhì)參差不齊等問題,導(dǎo)致這些問題的原因主要是我們?cè)诮梃b國(guó)外優(yōu)秀經(jīng)驗(yàn)方面存在誤區(qū),另外法律制度的缺失也是一個(gè)重要原因。因此,我們可以從行政調(diào)解協(xié)議性質(zhì)、人員素質(zhì)以及組織結(jié)構(gòu)等方面來(lái)建立和完善我國(guó)的行政調(diào)解制。我們深信,隨著行政調(diào)解理論研究的不斷深入,我國(guó)行政調(diào)解將會(huì)煥發(fā)出新的生機(jī),將在解決社會(huì)糾紛、促進(jìn)社會(huì)和諧方面發(fā)揮更大的作用。
[Abstract]:At present, our country is in a critical period of rapid economic development and social transformation. The main bodies of interest are diversified, various contradictions are intensified, these disputes are resolved reasonably and efficiently, and the stability of social order is maintained. Building a harmonious socialist society with Chinese characteristics has become the common goal of the whole country. It has become one of the important means for administrative subjects to resolve contradictions and disputes. Theoretically speaking, modern administrative law balance theory, administrative legitimacy and legitimacy theory, The contract theory provides a strong theoretical basis for administrative mediation as an important means of resolving contradictions and disputes. In practice, as a quasi-judicial system, administrative mediation can improve administrative efficiency and reflect the idea of good governance. Saving judicial resources, safeguarding the rights and interests of the parties, raising the awareness of citizens' rights and safeguarding the dignity of citizens will help to construct and perfect our country's diversified dispute resolution system. At present, the administrative mediation system in our country has vague orientation of the nature of the administrative mediation agreement, lack of legal effect, unequal status of the administrative mediation subject, lack of remedies by the relative party and unreasonable organizational structure of the administrative mediation. The quality of mediators is uneven. The main reason for these problems is that we have some misunderstandings in drawing on the excellent experience of foreign countries, and the lack of legal system is also an important reason. We can establish and perfect the administrative mediation system in our country from the aspects of the nature of the administrative mediation agreement, the quality of the personnel and the organizational structure. We are convinced that with the deepening of the research on the theory of administrative mediation, Administrative mediation in China will bring new vitality and play a greater role in resolving social disputes and promoting social harmony.
