【摘要】：迄今為止,30多年的市場化改革,使中國經(jīng)濟發(fā)生了翻天覆地的變化,在經(jīng)濟發(fā)展的背后,人民的法治觀念也隨著社會經(jīng)濟水平同步發(fā)展。一方面是經(jīng)濟矛盾隨著經(jīng)濟發(fā)展的不斷增多,另一方面是人民觀念從傳統(tǒng)厭訟心理到積極的用法意識的轉(zhuǎn)變,法院面臨著大量的小額糾紛。借鑒各國經(jīng)驗,我國在2012年的新民事訴訟法中,將小額訴訟法列入法典,然而在實踐中卻有許多基層法院不愿適用小額訴訟程序。因此,如何構(gòu)建一個適合中國國情的小額訴訟程序是當(dāng)下十分重要的課題。本文結(jié)構(gòu)共分為四個章節(jié)。第一章主要是小額訴訟程序概念的介紹,從整體上對小額訴訟程序進(jìn)行界定,并通過對小額訴訟程序與簡易程序的對比探析小額訴訟程序的法理基礎(chǔ);第二章著重介紹各國小額訴訟程序相關(guān)制度,去粗取精,汲取各國經(jīng)驗;第三章著重介紹我國關(guān)于構(gòu)建小額訴訟程序的司法進(jìn)程和相關(guān)實踐,進(jìn)一步分析小額訴訟程序在我國發(fā)展的優(yōu)勢與問題;第四章對我國構(gòu)建小額訴訟程序進(jìn)行具體分析,通過各國相關(guān)立法和實踐經(jīng)驗分析,結(jié)合我國基本現(xiàn)狀,對我國小額訴訟程序各步驟的構(gòu)建提出具體的意見。
[Abstract]:So far, 30 years of market-oriented reforms, the China economy has undergone changes in turn the world upside down, behind the economic development, people's concept of the rule of law with the social economic level development. One is the economic contradictions with the development of economy increasing, on the other hand, people from the traditional concept of mental weariness into usage consciousness positive, the court is faced with a lot of petty disputes. From the experience of other countries, our country in the new civil procedure law in 2012, will be included in the small procedure code, but in practice there are many grassroots courts to apply procedure. Therefore, how to build a suitable China conditions of the small claims procedure is the current important topic. This paper is divided into four chapters. The first chapter is the introduction of the concept of small claims procedure, defines the procedure as a whole, and by The legal basis of the small claims procedure and simple procedure comparative analysis procedure; the second chapter focuses on the related system, the procedure and learn from the experiences of other countries; the third chapter focuses on China's construction on the procedure of judicial process and related practice, further analysis procedure in the advantages and problems of China's development the fourth chapter focuses on the specific analysis; construction of small claims procedure in China, through the relevant national legislation and practice analysis, combined with the basic situation of our country, the construction of each step of our small claims procedure specific comments.
