【摘要】：俄羅斯刑事訴訟法中規(guī)定的法庭審理特別程序是處理刑事犯罪案件及時有效的審理程序。我國刑事訴訟程序借鑒和建立俄羅斯法庭審理特別程序中的量刑協(xié)商機制,有助于促進案件的繁簡分流,進而提高刑事訴訟效率,節(jié)約司法成本。俄羅斯的法庭審理特別程序及其中包含的控辯協(xié)商的司法實踐為我國認罪認罰從寬制度的完善提供了可以借鑒的藍本。我國未來設(shè)立的認罪認罰制度可以借鑒俄羅斯模式允許控辯雙方在起訴和審判階段針對量刑進行協(xié)商,并以刑事速裁程序和簡易訴訟程序為平臺構(gòu)建刑事案件審前分流機制和完善認罪認罰制度。
[Abstract]:The court trial special procedure stipulated in the Russian Criminal procedure Law is a timely and effective trial procedure for handling criminal crimes. Our criminal procedure refers to and establishes the sentencing consultation mechanism in the Russian court special procedure. It is helpful to facilitate the diversion of complicated cases and improve the efficiency of criminal proceedings. The judicial practice of the special procedure of court hearing and the negotiation of prosecution and defense in Russia provides a model for perfecting the lenient system of pleading guilty and penalizing in our country. The system can draw lessons from the Russian model and allow the prosecution and defence to negotiate sentencing in the prosecution and trial stages. Based on the criminal quick adjudication procedure and summary procedure, this paper constructs the pretrial diversion mechanism of criminal case and consummates the system of confession and punishment.
