【摘要】:行政訴訟第三人制度最早出現(xiàn)于西方國家,伴隨著司法實(shí)踐的不斷發(fā)展與理論研究的逐漸深入,這一制度日益完善起來。行政訴訟第三人制度的重要性在于對當(dāng)事人的訴訟權(quán)利及其他合法權(quán)益給予有效的保護(hù),對于法院快速、準(zhǔn)確的查明案件事實(shí),及時作出合理的判決也具有十分關(guān)鍵的作用。然而,由于我國行政訴訟第三人制度起步較晚,無論是在理論研究方面,還是在法律規(guī)定方面,亦或是在司法實(shí)踐方面,與日本、德國等國家相比,都顯得比較落后,還存在很多問題有待我們進(jìn)一步在理論上研究,在立法上完善。尤其是在行政訴訟第三人權(quán)益保障的問題上,現(xiàn)行立法規(guī)定薄弱,理論研究不足,導(dǎo)致在行政訴訟司法實(shí)踐中注重了對原告和被告的權(quán)益保障的同時,忽視了對第三人的權(quán)益保障,不利于在司法活動中對各方當(dāng)事人的權(quán)益進(jìn)行平等的保護(hù),故本文主要從行政訴訟第三人的權(quán)益保障方面展開研究和論述。除去引言和結(jié)論外,本文共包含四個部分:第一部分主要是對行政訴訟第三人制度的基本理論進(jìn)行了介紹。從行政訴訟第三人的概念、特征入手研究、在區(qū)別了其與相關(guān)概念的關(guān)系的基礎(chǔ)上,分析了其理論意義,指出了現(xiàn)行法律和司法解釋對行政訴訟第三人的規(guī)定。第二部分主要是對我國行政訴訟第三人權(quán)益保障中存在的問題進(jìn)行了分析。著重從五個方面來分析說明行政訴訟第三人權(quán)益保障的中存在的不足和缺陷。第三部分主要對域外行政訴訟制度進(jìn)行了比較和借鑒。運(yùn)用了對比分析的研究方法,從行政訴訟第三人的概念、分類、訴訟程序以及訴訟權(quán)利等方面對德國、日本以及我國臺灣地區(qū)的行政訴訟第三人權(quán)益保障制度分別進(jìn)行詳細(xì)的介紹,并在此基礎(chǔ)上概括出了出對我國相關(guān)問題立法的啟示。第四部分主要是提出的完善行政訴訟第三人權(quán)益保障制度的相關(guān)建議。筆者提出了完善我國相關(guān)制度的四點(diǎn)建議:1.明確行政機(jī)關(guān)可以作為行政訴訟第三人;2.合理劃分行政訴訟第三人的種類;3.明確行政訴訟第三人的訴訟地位、細(xì)化其訴訟權(quán)利;4.明確規(guī)定行政訴訟第三人參加訴訟的程序。行政訴訟第三人權(quán)益保障制度的研究對于保障行政訴訟第三人的權(quán)益具有十分重要的作用,筆者通過對比分析、文本分析法以及實(shí)證分析法對其進(jìn)行深入研究并提出了立法完善的建議,從而希望能夠?yàn)槲覈姓V訟第三人制度的發(fā)展起到自己的綿薄之力,同時也希望我國行政訴訟第三人權(quán)益保障制度能夠得到更多人的關(guān)注,從而使行政訴訟第三人的權(quán)益能夠得到充分的保護(hù)。
[Abstract]:The third party system of administrative litigation first appeared in western countries, along with the continuous development of judicial practice and the gradual deepening of theoretical research. The importance of the third party system in administrative litigation lies in the effective protection of the litigant's rights and other legitimate rights and interests, and the rapid and accurate identification of the facts of the case by the court. However, due to the late start of the third party system of administrative litigation in our country, whether in theoretical research, in legal provisions, or in judicial practice, the third party system has a very important role. Germany and other countries are relatively backward, and there are still many problems to be further studied in theory and perfected in legislation. In particular, on the issue of the protection of the rights and interests of the third party in administrative proceedings, the current legislative provisions are weak. The lack of theoretical research results in paying attention to the protection of the rights and interests of the plaintiff and the defendant in the judicial practice of administrative litigation, while neglecting the protection of the rights and interests of the third party, which is not conducive to the equal protection of the rights and interests of the parties involved in judicial activities. Therefore, this article mainly from the administrative litigation third party's rights and interests protection aspect carries on the research and the elaboration. Except for the introduction and the conclusion, This paper consists of four parts: the first part mainly introduces the basic theory of the third party system in administrative litigation. Based on the study of the concept and characteristics of the third party in administrative litigation, the paper distinguishes the relationship between the third party and the related concepts. Its theoretical significance is analyzed. The second part mainly analyzes the problems existing in the protection of the rights and interests of the third party in the administrative litigation in our country. The third part mainly compares and draws lessons from the foreign administrative litigation system. From the concept, classification, litigation procedure and litigation rights of the third party in administrative litigation, respectively, the system of safeguarding the rights and interests of the third party in administrative litigation in Germany, Japan and Taiwan is introduced in detail. On this basis, the author summarizes the enlightenment to the legislation of related problems in our country. Part 4th is mainly about the relevant suggestions for perfecting the system of safeguarding the rights and interests of the third party in administrative litigation. The author puts forward four suggestions to perfect the relevant system of our country. Make it clear that the administrative organ can be regarded as the third party in administrative litigation. 3. Make clear the litigation status of the third party in administrative litigation. The research on the system of safeguarding the rights and interests of the third party in administrative litigation plays a very important role in safeguarding the rights and interests of the third party in administrative litigation. The text analysis method and the positive analysis method have carried on the thorough research to it and proposed the legislation consummation suggestion, thus hoped to be able to play its own modest force for the development of the third party system of our country's administrative litigation. At the same time, we also hope that the protection system of the third party's rights and interests can get more people's attention, so that the third party's rights and interests can be fully protected.
